To Whom It May Concern: May 30,2014 First, I would like to state that Harley Exteriors main goal it to make all of our customers happy, do any project correctly, initiate all communications with any step of the process, and most importantly, to do the project right so that any home we work on looks beautiful. With this type of commitment and dedication from all employees at Harley Exteriors, we believe this is why we have an A rating from Angie’s List, as well as earning your Super Service Dealer Award, and we are extremely proud to have earned these privileges. Which brings me to the next point and that is we are completely surprised and confused about this complaint that [member name removed] is bringing up against Harley Exteriors. I don’t know how to describe this other than everything she is saying is untrue and I believe it to be slander, which is against the law. The course of events we have on our end is a signed contract dated January 21, 2014. We also have a singed “Notice of Cancellation* form dated on January 21, 2014, which explained to [member name removed] how to cancel the contract IN WRITING, and that we must receive it before the recission period ends which was no January 24, 2014 at midnight. [member name removed] signed on the form where is says she has received to copies of the “Notice to Cancel Form” and was explained how to cancel the order is she wanted to. We never received any written or even verbal communication from [member name removed] that she wanted to cancel the order from January 21, 2014, thru January 24, 2014, that she wanted to cancel and therefore our installation department then started to call her to set up a time to schedule the critical measurements and order her windows. The first 3 calls that were made were not answered; we left messages, and asked her to call us back. The next call she answered, said she was busy, and to call back later. Finally about 2 months later, around the first week of April, she finally answered the phone, and that is when she told us she wanted to cancel. We then informed her that her right to cancel expired on January 24, 2014, and if she did so then she would lose her deposit, which is clearly stated on our contract that she signed. We also communicated that we did not want to just keep her deposit. We wanted her to let us measure, order, and install the windows for her home. She then asked to see some jobs we installed close by her home and we provided [member name removed] with 3 job sites the same day within a few hours. At that time she only asked if we could provide her with a customer’s homes we installed windows in close by, and we did so. A few days later we called to set up a time for critical measurements and never heard back. [member name removed] claims about what Harley Exteriors told her are all 100% false. Our salesman, who has 20 years of experience, never got into pricing on the first appointment because we ran out of time that evening and therefore set up another time to go out and measure and deliver pricing. He never told them or put in writing they would get their deposit back of $5000. He never told them they could cancel after the recission period was over. He never told the customer there would be extra charges for asbestos. First of all they have brick siding, so we are not sure why there would be asbestos concerns. If there is asbestos, all we do is put up plastic and seal off all work areas to contain the dust and our works will wear masks and respirators for safety. We then would clean up the work area correctly, which is something we have to do on every project anyway. That being said we would not charge extra for putting up plastic and cleaning. Clean up is already included in our pricing. As far as damage to the brick, we have never damaged brick on any other previous projects. Our salesman never heard any questions or concerns from the customer about damaging the bring, and we believe it was because the salesman thoroughly explained the entire installation process. On May 13, 2014 Harley Exteriors did not tell the customer “it is illegal in the state of Washington to refund a deposit after 3 days”. I know this because, I, Christian Daher, the Owner of Harley Exteriors, spoke directly to [member name removed], and I told her that if she cancels after the 3 day recission period is over, the she would lose her deposit and not receive any windows or installation like it says on her contract. No one at my office, or myself ever yelled at [member name removed]. We don’t treat our customers that way. In this complaint [member name removed] clearly states that she went and got more estimates after signing a contract with us. [member name removed] was told other things from a different company that has nothing to do with our company, the project, or the price. This should have any bearing or impact with the agreement that [member name removed] made with us by signing a contact and giving Harley Exteriors a $5000.00 deposit. In conclusion, Harley exteriors never told any of the lies that [member name removed] claims that we did. Harley Exteriors has done nothing wrong. Harley Exteriors has signed a contract that shows when to cancel an order by, we also have a signed Notice of Cancellation form from her that clearly states she has received 2 copies of it, [member name removed] never canceled in writing and has no proof to show it, and she has no right to get her deposit back. What kind of protection does a company lose if we were required to take such actions? Harley Exteriors is willing to proceed with the project and install the windows for the [member name removed]. We will promise to do a great job, we will install it correctly, and the house will look beautiful with the brand new windows. We will back everything up with our Double Lifetime warranty on both the windows and installation. We are willing to do it for the same price even though we had a price increase back in March. We are willing to cancel the project without returning the deposit because commissions have been paid to the salesman, sales manager, marketing rep, and marketing manager. We also have a lot of man-hours from the administration staff, installation department, not to mention myself as well. We would love to install the windows for the [member name removed] and do a fantastic installation for them so they get the best value for their money. In addition, we also would ask that Angie’s List please take down this false complaint against us because it is hurting our reputation and it is slanderous which is against the law, and the complaint is not true or valid.
