The member called our office a year ago regarding water getting into the heat ducts in his basement. At that time we suggested a pump pit inside the basement. He chose not to have the work done. He again called our office in July 2008 and Wayne Roberts met with him to evaluate the problem. The member was mailed a written contract with the details of the work to be completed. He agreed to have the work done and signed the contract, wrote a down payment check and mailed the signed contract. Upon receipt of the signed contract we scheduled a start date. We arrived on the scheduled day and completed the work. Edward Moore was the job foreman assigned to the project; he has worked for A-1 Indiana Waterproofing for 15 yrs and has extensive knowledge of foundations, hydrostatic pressure, drain tiles and concrete block work. Our labor force is hard working and efficient when performing projects, while maintaining quality workmanship. The member's complaint is that the work was completed too quickly and questioned whether a lid was placed over the pit when installed. He also stated further in conversation with Wayne Roberts that we didn't use large equipment to excavate. The contract clearly states hand dig. This was intended due the work are being so congested and the possibility of disrupting the landscaping and working so closely to a greenhouse. Our men excavated a 6' basin and 40' of exit line at a depth of 3' - 4' to move water away from the home therefore, relieving the hydrostatic pressure, In our 30 years of business in the field of construction, we have learned that it is impossible to determine exactly how long a project will take to complete. We have never had a request for a refund for a project that was completed as the contract was written. Occasionally, work that is contracted and agreed to by both parties requires a change in the contract. This is handled with a change order. A change order is written when the original work to be completed is changed either by customer request or additional work requested to be done by the customer, therefore, resulting in a credit or additional charge, all of which is handled in writing before the additional work begins. More times than not a project takes longer, we are not entitled to charge additional money in these cases. In this instance, A-1 Indiana Waterproofing actually completed more than what was on the original contract by installing a tile under the basement floor, from the outside, to attempt to relieve hydrostatic pressure in heat ducts. In addition, we addressed a downspout in the area of the outside and let it out and away form the house, therefore, moving more water away form the home. The downspout was perforated and we felt it was adding additional water to the area of concern. However, minor as this may seem, not properly maintaining the gutters and downspouts can cause surface water issues later on. A-1 Indiana Waterproofing always tries to go above and beyond our customer's expectations and resolve any issue that we may encounter during the course of a project without additional changes to our customer. We feel the calculation of the member's cost and material costs are not adequate indicators to determining the value of a project. Overhead, insurance, vehicle expense, advertising cost, administrative cost, fuel expense, both during the sales process and work performed, expertise in hydrostatic pressure and other related direct, indirect, warranty and overhead expenses should also be considered. Furthermore, to reimburse him 52%% of the original contract amount after the work was completed and paid is unreasonable. A-1 Indiana Waterproofing will offer to dig up the pit area to insure that there is a pit lid installed. If there is verification, then A-1 Indiana Waterproofing will charge a $500.00 service charge. If there is not a pit lid, then A-1 Indiana Waterproofing will reimburse the member $2,500.00 as requested.
