Angie's List Complaint: No resolution. Freeman Fence offered me the opportunity to pay for another gate. This offer was insulting since they built the gate without considering my requirements (open and operate as the previous gate) and failing to perform the work per my specifications and the poor workmanship per a home inspection. Better Business Bureau Complaint: No resolution. Roger Freeman, Owner, Freeman Fence, threatening demeanor making reference that my complaint is "slanderous" to his business. Refusing to resolve by fixing the problem, refusing to refund any money for the gate, and immediately requesting that I arbitrate using the BBB. I do not have much faith in the BBB process and it should be a red flag when their resolution is to arbitrate without trying to resolve a complaint with the customer. Legal Counsel reviewed and letter was sent to Freeman Fence: No resolution. Roger Freeman contacted the legal counsel and said they will not refund any money. Roger Freeman, Owner, said that he is considering legal action against me for slander by submitting complaints against the contractor to Angie's List and BBB. Description of Work: January 21, 2014 Lisa Madigan Illinois Attorney General Consumer Fraud Bureau 500 South Second Street Springfield, IL 62706 RE: Roger Freeman, Owner Freeman Fence 3515 Cleveland Avenue Brookfield, IL 60513 Phone: 800-495-0485 I hired Freeman Fence, November 5, 2012 to repair and replace my existing cedar fence with “new posts” that had rotted due to a previous fence company that did not properly cement the posts all the way through to the ground and used rocks and, most likely, only one bag of cement; just enough to hold the posts in the ground. In addition to replacing the posts, I requested a “gate” be installed in the exiting spot replacing the metal gate. The salesman, Andy Jedrzejczyk, was very devious, as had all other fence contractors, explaining that the entire fence had to come down then re-installed; it’s a lot of labor according to Andy and the price reflected that. In addition, I spent a great deal of time explaining the details of the gate. I wanted the gate to close the same way in the existing direction, everything would be the same; the wooden gate would replace the metal gate. I asked for sample drawings and pictures of gates and received none of what I requested. You’ll love it, he kept saying to me. I kept asking for design options up until the installers came, and still, no photos to choose my option. They did not “bring” a fence, they “built a fence” on the premises from scratch. The issues of my complaint are referenced below. Roger Freeman, the owner, had been playing games with dates for the last year. Setting up a date and cancelling many times over; weather, extreme cold, rain, cannot work on weekends, etc. I have initiated every call. My last call was my final attempt to find resolution before further action would be taken. October 17, 2013 Roger set another date to resolve the list of issues. We had rain during that particular day. The afternoon cleared up and I rushed home to meet the worker and no one showed up at the property and no attempt to call me to cancel or reschedule. Page 2: When I spoke with Roger Freeman, he said that it was raining so no one came. Roger wanted to send workers while I was not home, and I told him that would not be acceptable. No work is to be conducted without me on the premises. I would only allow the clean-up that was not completed a year ago. I made it very clear that no work on the gate will be performed without me. He said that he will follow the drawings. I told him that the original gate problem resulted from the salesman who drew the gate how he wanted it installed, not taking into consideration my specifications at all, thus the paperwork was not accurate. He would not authorize any weekend work, knowing that I did not have any vacation days that my job would allow. Roger has never spoken to me again; he stopped taking my calls and will not return calls. I left one final message telling Roger that I will file a lawsuit if an appointment is not set to complete the work. I further gave Roger 30 day notice that I will be home on Thursday, November 29, 2013 (day after Thanksgiving) and asked to confirm the date. No responses after two messages were left on the office number voice mail. Freeman Fence was a NO show. I am requesting that Roger Freeman complete the project as noted, and bring approximately four (4) bags of pea gravel to return the vegetable garden landscape back to where it was before all the debris was dumped in that area of the landscape. If Roger Freeman feels that he cannot complete the project as noted, I will accept a refund of $350 for the gate and remove it from the premises and four (4) bags of pea gravel for the landscape. A copy of this complaint will be forwarded to the Evergreen Park Village Hall, where I requested a list of licensed and insured contractors. Problem 1: False Estimate November 8, 2012 the installers arrived late, thinking there would not be enough time in the day to finish the installation. During installation I watched the men replace only the posts, without ever taking down the fence, as the salesman had explained, confirmed he lied and resulted in an exaggerated and overpriced estimate! Problem 2: No clean-up and leaving the landscape with rock debris and cement grit in the yard and landscape The installers removed the debris from the bottom of the hole and dumped the rocks next to each post as they installed the new posts; approximately 12 posts. Upon completion, I expected them to clean-up the debris, they said no. What would I do with all the debris? They hauled away the rotted posts, however, would not pick up the debris. That was not acceptable. After they left, I tried to haul away all the rocks and clean up the landscape and found out there was too much work for me to drag it to the alley because I could not dispose of the rocks. In addition, the landscape with the pea gravel was now a mess. I would need several bags to spread over the mess to hide the debris from view. Page 3: Problem 3: Gate installed on incorrect wall and swings in the opposite direction When the installers began to work on the gate, there was loud drilling coming from outside so I quickly ran outside to see what they were drilling and stopped the work immediately. They drilled a 3 inch circle into the cement patio. I had them explain what they were doing. They responded that a post would be put down into the cement patio to get a fence post to hold the gate. I immediately told them this was NOT what was discussed. I told them I would immediately call the salesman, Andy, to get an explanation. I called and left several messages without any response. I tried to get them to install the bracket where the original gate was located and they did not think that would work because of the wrong type of brackets. They came up with another option that I did not like and it still stands today. I told them I was not happy with the gate because it is not closing in the direction as the previous gate. In good faith, I paid them and told them they need to figure out what proper bracket is needed to allow the gate to swing the other direction and be installed on the opposite wall. I explained that there is a strong wind that whips through this archway and the wind will be strong that the fence may not hold without having some air to pass between the slats; currently they are close (side-by-side) and (end to end(, not allowing any air to pass through. The following day the salesman called. I told him I was not happy with the gate and reaffirmed why I needed him to provide photos so that I can choose my option. The gate was hung on the wrong wall and not closing in the right direction. If the gate cannot be accomplished by finding the proper bracket, I told him I will search the internet myself for the proper brackets and you will return to hang the fence and have it swing in the proper direction. He told me, angrily and screaming “YOU’RE NOT GOING TO TELL ME WHAT TO DO!” The salesman hung up the phone. I called him back and he hung up again. Immediately, I called the main office number to speak with the owner, who was on vacation. I told the office about the conversation with salesman, Andy. I demanded to have the owner call me. In addition, I told him that if the salesman shows up at the house I will call the police. He is to have no further contact with me what so ever! Problem 4: (RESOLVED) The posts were not cemented using conventional methods, Freeman Fence used dry concrete mix At first, there was much screaming from both the salesman, Andy, and the owner, Roger on this subject of “cementing the posts” as stated on the contract. A few additional phone calls later, Freeman Fence provided documentation of this alternative way to cement the posts in a dry method – less expensive and less time consuming installation. Subsequently, this has been resolved. However, only time will tell how if this method stands up to time. Page 4: Problem 5: The gate is too close to the ground and needs to be shortened a few inches Winter came with snow and ice that builds on the cement patio. The gate is constantly wet and will create rot shortening the life of the wood. In addition, in the summer, I cannot get the water hose under the fence, and I must have the gate opened constantly while using the house, creating no privacy Problem 6: The lock needs to be replaced As I had explained when the gate was built and installed, I said that the wind is strong and may not hold as built and installed. The gate sits on a wall that has to be propped open and when the winter wind blew, it slammed the gate shut bending the lock that now needs to be replaced. Problem 7: The gate interferes with the exiting decorations that I cannot use I am not happy that I cannot hang my decorations because the gate hangs on the wrong wall Problem 8: The board that is attached to the garage brick that hold the lock in place is not attached properly I recently had a home inspection and it was noted that the job was not proper because the board is not held in place and is not securely fastened to the wall.
