Monday, April 15, 2013: We meet at the pool and discuss the following: Liner will be removed; base will be repaired with cracks filled and rough spots smoothed; pool will be checked carefully for leakage problem and if necessary one of the returns will be plugged up and only one return will be used; worst case scenario the pool water will be circulated through the bottom drain only; new liner will be put in place; coping around the pool will be repaired; pool will be ready to swim on April 28. The provider insists on placing some patting in the pool for a smoother surface and a "better feel". Sunday, April 28: Pool is far from ready to swim. Monday, April 29: Pool is being worked on; accident ? worker falls off the trailer and is brought to the hospital by an emergency vehicle. Worker uses one hand only to do work on pool walls ? the other hand is on the cell phone ? for many hours ... Thursday, May 9: The pool is declared to be finished; it is raining and the pool cannot be inspected carefully; the final payment is made. Inspection of the pool yields the following: * The coping is not replaced all the way around the pool. There are big gaps between two pieces of coping. * The liner is not leveled as the distance with the water surface shows. * The new pipe connection near the pump - necessary because a piece was broken during the work - is not straight. * In the shallow end there is a ?little step? on the wall behind the liner that may hurt somebody expecting a solid wall there. * The patting on the floor in the shallow end has pieces of gravel on it that hurt when unsuspectingly putting down the foot. * The transition between the slant and the shallow end is abrupt due to the patting. *The pool wall behind the liner is very rough in places with pieces of gravel which may hurt somebody expecting a smooth wall there; this may also cause the liner to age prematurely. * Two places in the deep end show dents in the pool wall. Monday, July 29: E-mail from my friend to me while I am out of town: the pool looses water and the pump is turned off since the water level drops dramatically. The pump may have been damaged due to lack of water. The water level stops dropping below the two returns. Sunday, August 11 and Monday, August 12: Upon my return, I leave phone messages for the provider about the situation. Monday, August 12: The provider returns the call and will come Tuesday, August 13 in the afternoon. Tuesday, August 13: The provider comes and leaves so quickly that when I leave the house he is already at the end of the driveway without paying attention to my waving. He does not answer his phone. Wednesday, August 14: The provider answers the phone "Silly girl, you should have asked me to take care of your pool while you were gone, then this would not have happened". I tell the provider that the pool leakage needs to be found and fixed at no cost. In this process, the water shall be restored to swimming quality. However, the provider insists that he has done everything that he could do. He checked the pipe to the returns and they were fine. There is no reason why the pool should leak now and he is not willing to repair and clean the pool at no cost. In conclusion, I have a new liner (with several issues associated with it) which is of no value for me since the pool leakage has not been resolved. I seek resolution with the provider that he will * find and fix the leakage problem in an acceptable way, and * restore the pool water to swimming quality. The provider will do this at no cost to me.

Response from Fairmont Pool & Spa Service
I am happy to provide you with over 1,000 homes of happy happy happy customers. I do about 450 pool and hot tub jobs per year. That's because I do excellent work. 3/27/13 (Wednesday) Observed pool and put together a list of needed supplies to complete the job. The pool was 25 years old and the coping was broken in places. The type of coping is no longer made or sold. It took approximately 12 hours of searching and contacting different pool suppliers until I found a supply of new, old stock Radiant Pool coping that I could purchase. 4/10/13 (Wednesday) I met with Martina to go over 2 different bids, the process of rebuilding the pool, and approximate time frames. I took a deposit check (#677) of $4,512.95, which would cover the liner and coping purchase. I had to drain and remove debris before I could measure for the custom liner, which takes 1.5 weeks to have manufactured and delivered. I also had to order the coping and have it delivered. I was unable to start the project until 4/16/13 (Tuesday) because of the current project I was working on and needed to complete. Martina was told about this. 4/15/13 (Monday) I met with Martina to pick up the 2nd installment (#679) in the amount of $2,256.48, with the balance due at completion of the project and upon her satisfaction. These funds would cover the new heater and some of the labor on the project. 4/16/13 (Tuesday) Removed decking, coping, light assembly, and heater. 4/17/13 (Wednesday) Drained pool, which you can see in the pictures, was above the returns at the shallow end of the pool. Tested return lines and they were holding pressure. 4/19/13 (Friday) Completed clean-up of the pool. There were 10 bushels of rotted leaves at the bottom. 4/22/13 (Monday) Measured for the liner and prep for the coping being delivered on 4/24/13. Also ordered liner on this day. 4/23/13 (Tuesday) Delivered new heater, removed old liner, hauled away old line, heater, and decking to the dump. 4/24/13 (Wednesday) Pressure cleaned and scrubbed the pool walls. Removed bad pool base, scrubbed the base with liquid chlorine to kill any existing algae growth. 4/27/13 (Saturday) Reworked pool base to a smooth, consistent finish. It took 250 lbs of pool base and 90 lbs of Portland cement to complete the task. Refit new coping. It was replaced only where the wood deck touched against it. The coping bordered by concrete was not broken and was in good shape. This was known by Martina. 4/29/13 (Monday) Picked up liner in Pittsburgh. Completed final preparation of pool structure. Installed “Happy Bottom” on shallow end of pool as shown in pictures. 4/30/13 (Tuesday) Installed liner. Installed evacuator to remove air from under the liner to ensure proper fit. Began filling pool. 5/1/13 (Wednesday) Pool still filling. 5/2/13 (Thursday) Pool still filling. 5/3/13 (Friday) Removed evacuator and pulled winkles. 5 inches of water in shallow end of pool. Looked beautiful. 5/4/13 (Saturday) Re-plumbed pool heater, pump, and filter. Wired the heater to the outlet. 5/7/13 (Tuesday) Cleaned up the job sight. Rechecked all work. It was raining when I left. Customer refused to pay because she could not see the finished work. 5/9/13 (Thursday) NOT RAINING ON THIS DAY. The gas company came and installed the propane tank for the heater. I started the pump and motor. Fired up the heater and adjusted the pool chemicals. The pool was beautiful, as seen in the photos. She said she was happy with the pool. Final payment was made by check #679 in the amount of $2,000.00. Customer withheld $100.00 because she felt time frames were too long. 8/14/13 (Tuesday) Spoke with Martina. She was unhappy about water loss. This was the first time I had heard from her since the completion of the project. This pool is plumbed with old black pipe and must have breached sometime after the completion of the rebuild. It was fine from 5/9/13 until her complaint on 8/14/13. I feel I did an exceptional job on her pool. I did not take my short cuts at all. Also, I was not on the phone while installing the liner. It is impossible to install a liner with one hand. Also, the worker getting injured on the job had nothing to do with any of this situation. The pool looked and ran beautifully. I don’t feel I am responsible for a leak that happened after the job was complete for nearly 4 months. I will not return to her house even if she agreed to pay me. She was a very difficult customer to deal with and was out of the country for most of the project. She left her neighbor responsible for overseeing the progress.
