Things were moving along fine for a bit, then completion dates were over run. There were numerous inside items that were being worked on until well into August. When it came time to work on the outside, Scott came to us and asked for more money "because the previous owner is having money problems..." and he didn't have the money to buy the wood for the deck or fence, which he said he was out buying the week earlier. Then when it came time to build the fence, I looked up and gave Scott the number to the diggers hotline. Well, he didn't call because he "built this house and knows where everything is." As I was 100 miles away at a medical evaluation, I received a call from my wife stating that Scott had just hit the gas service line to the house. At some point Scott tried getting my wife to call the utility company to have the gas shut off, it wasn't until she suggested calling the fire department that he called for help, all the while saying how this was all MY fault. Then it took another week for Scott to finish installing the prebuilt fence panels from Menards because he would always have somewhere else to be and would leave his laborer here to work by himself. When they left early that day, I was told that they were taking some panels back to his shop to build the gates (2 small gates and 1 large one for across the driveway), he had to measure another job first thing in the morning but they would be here by 9AM to put the gates on. Well, by 1 in the afternoon he texted my wife, saying that the gates aren't built yet and they will be here first thing tomorrow. I didn't hold my breath. They did eventually show up and install the gates toady, but then loaded the truck and took off without a word. There are some things that have yet to be finished from the Final Inspection that the inspector says need to be completed, like fire caulking the garage wall around one of the trusses. I still have no driveway and no idea when to expect the driveway to be installed. Scott has refused to have any contact with me ever since he cut corners by not having the yard located for underground utilities. Scott has shown himself to be a liar and a thief as far as I am concerned. This is unfortunate because his laborer is a good guy and does really good work. If this work is not completed in its entirety very soon, I will have no choice but to contact the BBB and a lawyer. This company certainly will not be hired for any further work here or by my family and they most likely will not be granted any work permits in the City of Brodhead based on how he has acted thus far. UPDATE: Well, we called the paving company that we were told was paid to put our driveway in and was informed that they had not been paid for anything yet. Now we have the 2 realtors and previous owner trying to contact Scott to find out why. We were told by the previous owner that everything was paid for, Scott even said that the paving was paid for. Scott has proven himself to be a thief and a liar. Avoid this guy at all costs! UPDATE: I have reviewed the response made by the business in reference to complaint ID 9184091, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Mr. Kapinski has a very interesting perception of reality. It is no secret that the initial workmanship of the home was good and appreciated by us. However, there are some major issues with the remainder of his response. I am at least happy that he recognizes that he was in violation of the contract by the completion date promises. The issue with the finish was brought to his attention much sooner than he states, it just took over a week for his plumber, Bobby to come out to the house and inspect the issues with the bottom of the tub and the shower. He stated that those marks were caused by the dry-wallers having screws in their shoes and stepping on the bottom surface. he informed us that the repair is the responsibility of Scott and he would be supplying him with the correct repair kit to fox the holes. I am not sure why he felt the need to say he built a "custom" cabinet to cover duct work, when that was part of the initial construction, and to be honest, it is nothing special. My 10 year old son could have built a better shelving unit. The gas leak was in no way my fault. I did point out the yellow paint on the curb, but also stated that there is no way to know where the line ran in the ground. I even looked up the diggers hotline for him to call as I believe I previously stated. This should be confirmable with his laborer, that was present during all of these conversations. He also made the comment to my wife after hitting the gas line, that he thought Scott should have had the yard located, but couldn't say anything because he didn't want to jeopardize his job. I did make the question of the fence falling under the original remodel construction permits, but said that was beyond me and differed to Scott who should have know better, as he states. From what I was told by people on the scene of the gas leak, Scott made a very bad impression on the Fire Department personnel and the Wisconsin Energy personnel and screamed many damns to my name. again, I was out of town during this time. When I discussed the final inspection issues with Scott, he said HE would just take care of the garage and not bother Wendy (the previous owner) with it. Again, I am disabled and can not do the work myself and would never make that statement. The contract was for the basement finishing, 2 storm doors and a fence. The quote that was signed and returned was for $6,090 down and $2,050 upon completion. Scott messed up the initial deposit with his bank and we had to make a special trip up on a sunday to get him cash so he could buy the carpet for the basement and then paid him the remaining difference when my wife arrived on wednesday. Then, we had Scott fix some trim around the garage and a transition deice in the kitchen and he was going to stain the fence white. On 07/27, Scott approached us and said he was having difficulties getting paid form Wendy for some things and if we wanted our deck (part of the sale agreement) and fence built, he would need more money. I have a printout from my bank as well as a copy of the check we wrote for $2,750 to Inside & Out Construction on that date. We had a verbal contract, but if he says we didn't then I guess we over paid by $700 and would like a refund, immediately! The driveway was discussed many times with Scott and he repeatedly stated that it had already been paid for. According to our conversation with Wendy, she said that Scott called her 2 days before the closing (7/13) and said he needed an additional $10,000 to finish the house. I find it very interesting that the tone of her email the he has attached is such as the phone conversation my wife has had with her have been VERY different. Thanks,
Description of Work: This contractor (Scott) was doing the remodel work on a home that we purchased. We purchased the home prior to the contractors work that was supposed to be paid for by the previous owner. We asked the contractor if they could do some work for us prior to moving in: Finish part of the basement, run phone and cable lines to 2 upstairs bedrooms, fence in the yard for our dog, paint/stain the fence to match the house trim and install 2 full view storm/screen doors. All with a promised completion date of the end of July for the exterior, which included a deck and driveway that were supposedly already paid for by the previous owner and July 18th for all of the interior work. We signed the estimate in good faith and gave more than 50% down as he requested. The contractor never called the city and received a final inspection prior to the closing and our moving in. That was done when I went to the city and got the permit for the fence to be built, because Scott neglected to do that as well.

I was given the opportunity to rehab a house in Brodhead WI. The house was completely gutted and what I basically did was build a new house inside of this old shell, why did I not just tear it down and start fresh? Well the owner had someone else put a new attached garage up and then all new windows and doors and then they put new roof and ne siding on it and who ever that contractor was didn’t know squat about structure because most of the framing around the new windows not only were not up to code they didn’t even follow basic knowledge on how to frame windows and door openings. Myself and a select few tradesman ( carpenters, plumbers, electricians, etc…) that I subbed out for the owner, we literally had taken bear s**** and made it into honey, when the Schimians, your member, came to look at the house with there agent Greg, the couldn’t stop praising our work and ranted on about how they were going to put us on Angie’s list with great revues, and it’s true we did finish the basement and build them a fence, but what they aren’t telling you is the truth. It’s true we did delay the deadline for the finish of the inside of the house, we still needed to touch up paint and hand rails so I suggested to the new homeowners, Members, the Members that we would finish after there moving company was done because walls will get bumped, scuffed and scratched and when moving big things upstairs hand rails can get in the way as well and a lolly column cover I had to pickup yet needed to be installed in the basement as well, they seemed pretty happy that we considered holding off with those projects. I also built a floor to ceiling cabinet to cover the exposed duct work in there kitchen. As for the gas leak and the permits for the fence, I had never said that because I built the place, I knew where all the utilities were, your member, continually kept saying to me you don’t need a permit there is already a permit for the construction of the house! Yes, I should have known better but, we started with the corner post by the Member markings and the city utilities supervisors caught one of my subs setting the corner post and stopped an asked if we had a permit and if we knew about the variances etc.. so then we had to wait for the permit, delay #1 and as for the permits and final inspection that was all the previous homeowner who was the general contractor, you would have thought someone at that closing table would have wanted to see a certificate of occupancy??? The permit for the fence was the Member’s responsibility, I was a sub contractor I never pulled a single permit on that house! I asked them to call diggers hotline but, Member was pointing out that the marking for the gas line was right at the curb, he literally stood in the road and eyed it up! Bottom line is your Member was the reason for postponed deadlines for the fence because he thought it could get done faster by cutting corners, by not filing a permit and not scheduling a locator, I assume it was because he was sick of walking his dog! The part where he accused me of not talking to him completely false, after the gas line was struck he refused to acknowledge me, he wouldn’t even look me in the eyes let alone even come near me, so I did all my corresponding with his wife after that, who by the way did call the utilities company, because I told her too, because I was going to get the fire department that was just down the street five blocks away which was faster then calling. Then even though we now knew where the gas line was and there were no buried utilities, we still had to call a locator from diggers hotline, delay #2. After the locator marked out the property, the fence and gates were completed in four days, one day at my shop building gates and the other three on location. The painting of the fence was not in our contract it was a suggestion the Member made, so I gave the Member a price, and we never charged them for it, there for we did not break any contracts, as for the caulk on a n open truss in the attached garage that, “ I did not build and did I mention I was not the general contractor,” the Member suggested that the idea to the inspector which he told me he would do himself, what the previous contractor did was cut pieces of drywall and insert them in the truss webbing instead of behind it which is common practice for a attached garage, I think the truss should have been completely covered and fire taped, but the inspector settled for the fire caulk, so we decided to finish what we were “paid” for and when the fence was finished we chose to leave and not look back. Since then I received two text messages from the Members wife, that evening when my phone was charging in my office which was also the same day he filed his complaint 8/16/2012 and the next morning when I was starting a new job for the previously satisfied customer. As for there driveway I have this e-mail from the previous homeowner explaining the driveway and why the paving company wasn’t paid yet; Scott – I don’t know for sure what is going on with the new homeowners, but I apologize if they are accusing you of stealing money, that certainly never came from me. I haven’t even talked to Stateline about the paving yet, so it is not scheduled, so that is my fault. Like you, I am more than a little annoyed that they have any room to complain at all considering everything we did above and beyond to make that a nice house. I lost over $5,000 on the deal, mainly because I trusted Archie to list the house at a fair price and he priced it way to low. The owners got a heck of a deal and should be thrilled. I know you did everything you could to help me out and I appreciate it very much. I am sorry if you are getting any grief on your end, that was certainly never my intent. So without question the plumber ordered a repair kit for the chips in which Member wife, said she would fix herself. As for all the people the Member has searching for me? I have yet to receive any contact from them except the owner who I contacted, and well you just read above what she had to say! I have names and numbers of people in my area as well as in Brodhead and contractors who have worked with me that will speak out in my behalf, for my integrity and of my work! It’s really sad that I have been forced to defend myself because a guy like this, your Member , who can just go on the world wide web and spread lies, the consumer has all these avenues in which to state there complaints, where is the contractors protection from the consumers like him? Whose the real victim? Note to all contractors this member should be avoided at all cost!!!
