Henneman Roofing

We signed a contract with Mr. Henneman on October 16, 2013, and he said it would only take a few days to hear from him regarding delivery of materials. On October 26th we called him requesting an update on the status of materials and work, and we continued to leave him messages every 2-3 days requesting a call back. Not knowing what else to do, on November 7th we filed a report with the BBB. We have contacted our attorney letting him know of the situation. So far, we have not taken action. We wish to purchase another home that we have already found, contingent on the sell of this home. Part of the process of selling was to replace the roof in order to make the property more desirable. Now, in addition to a worn out roof, there are jacks and shingles stacked on the roof. Two of our door overhangs have had the shingles removed, and one is loosely covered with hand-tacked underlayment, while the other has the underlayment exposed. There are two roofing jacks on the gables on the house with shingle bundles stacked on top, as well as the flat part of the roof over the garage. It is unclear if enough shingles to complete the roof have been delivered so far, and the contract was for a square of shingles. We were supposed to have them delivered by 11/15/13, but they didn't deliver that day. We then had to contact Mr. Henneman again, and when he returned our call, he explained the weather would be wet over the weekend, and he didn't want to leave additional underlayment exposed. That seemed reasonable. Although workers have just arrived today to work on the roof over the porch, we are concerned that the money we gave Mr. Henneman for shingles may not have been spent for our job. Apparently, shortly after signing the contract to do our roof, Mr Henneman sub-contracted to do a large apartment job. His company truck and trailer have been seen at the apartment job since he contracted to do our roof. We found out that he has had judgement against him for not paying for his websit, and this information was brought to our attention by the BBB. It seems he has had some server financial issues. He has not provided us with a lean waiver, and we are concerned about whether he used our downpayment appropriately.---I have had leak on south dormer because they left it partially unfinished. The north side area over the garage which wasn't even part of the contract they did most of there staging there and destroyed the roofing membrane over the garage so now that will have to be replaced and cost extra money. Cut a hole in the membrane over the flat roof so we have had severe water damage there. They left dams above the dormer that should have been leak proof and also caused a leak there. They left materials up in the dormer that also caused ice damage. They did not clean up the materials as they went along they just threw them in our yard; now our yard is covered with debris.
