Melissa Brumbaugh - Re/Max All Points

On March 11, 2013, Mrs. Brumbaugh entered into a contract with us to purchase our residence in Roanoke, VA. The contract contained in it a stipulation of a nonrefundable $1500 deposit, which the purchaser would pay the seller if he/she canceled the contract of sale. Mrs. Brumbaugh changed her mind about purchasing our house and used a technicality to renege on her contract with us. She also refused to pay the good faith deposit of $1500 she agreed to, thereby violating the terms of her contract with us. She had an attorney write us a letter stating that she would sue us if we did not release her from her contract. As sellers, when we entered into contract with Mrs. Brumbaugh we were required to take our house off the market during the most peak and valuable selling season of the year. There were other contracts on the table at the time which were lost because of that. We also lost that amount of time that we could have had our house (back) on the market to potentially be sold. She violated the terms of her contract with us by refusing to honor her agreement to pay us $1500 if she terminated her contract unilaterally. We believe that Mrs. Brumbaugh acted in a manner that violated the code of ethics as a realtor in the commonwealth of Virginia and that was clearly unethical and perhaps illegal as well. We wonder how her behavior might impact her business dealings with her real estate clients.
