Asset Enterprises Virginia Sole Proprietor License # 2705036277A Unfulfilled Obligations of the GC (Asset Enterprises) *Failure to Install Air Filter and (Failure to Install Dehumidifier/Humidifier Unit) GC failed to install the air filter in the air handler, as well as the humidifier/dehumidifier unit – both are specified in our contract (Exhibit C, Section 15): Section 15 - Heat / Air Basement: American Standard, 13 Seer High Efficiency heat pump, 1.5 ton Attic: American Standard, 13 Seer High Efficiency heat pump, 1.5 ton Humidifier: First Floor Air Handling Unit. Furnace filter system. Air Exchanger: design per mechanical contractor The heat pumps do not run very long, the moisture does not come out of the air and the hardwood floors have warped as a result. Air Filter installation will cost approximately $5,000 .00 (as per 2 estimates given by local contractors not involved in this construction). Window Screens Residents have not received the screens for the windows (now 9 months after occupancy), even after they visited GC’s office to reclaim them. GC was notified by residents’ attorney to deliver the screens (letter sent in August 2010). Screens have not been delivered as of December, 2010. Green Board Not installed according to construction specifications. Green board was to be installed in all bathrooms, kennel room and kitchen. GC promised instead to cover drywall with 2 coats of epoxy paint. This did not occur. Construction Defects Windows At least 4 of the upstairs windows were incompetently installed, resulting in a 1mm gap in the window frame that lets in light. The second floor window in the stairway resembles a rhombus, not a 90 degree angle square. Hot Water Hot water was attached to the toilets, making it expensive and time consuming to fix – the plumber said he would have to tear out the ceiling and walls to complete the repairs. Concrete Cracks in the basement slab were first noticed within 5 weeks of occupancy. Cracks are also noticeable in the porch slabs. Nails Nail pops are apparent in every room of the house; first noticed approximately 7 weeks after occupancy. Lack of Paint Several ceilings throughout the house were primed but not painted. Lack of epoxy paint (as specified in contract) Basement room was to have epoxy paint on all walls and ceiling. Ceiling was primed only – no epoxy paint was included. Exterior Bat and Trim Both have shrunk and warped since March, 2010 (occupancy date). Exterior trim is particle board – not meant for outside use. GC brought exterior trim to site already primed so home owners were not aware that it was not composite cement board as specified in the contract. Gutters Gutters are too small to accommodate pitch of roof.
Description of Work: Asset Enterprises was hired as GC to build our new home. Construction went 6 months over agreed upon completion date; home owners incurred additional bank fees as a result. GC pulled his entire team off the construction site one afternoon because he believed the owners were not requesting his bank draft soon enough. Owners had 15 business days to request bank drafts and each was requested and delivered within this time frame. A list of unfulfilled obligations of the GC follows.
