Description of Work: My blood is boiling after reading Tommy Croker’s response to my negative review of his company, Arlington Heating and Air Conditioning. It is a total Crock of (excrement), and demands immediate correction. Mr. Croker’s response is nothing but hot air, just like what came out of our air conditioner after his firm, Arlington Heating, completed their annual “maintenance” check. The AC unit worked before their service visit. It did not work immediately after their visit, and never worked again. If Arlington Heating worked as hard to resolve a good customer’s legitimate concern as they have trying to spin away what happened and go after the customer personally because they can’t attack what he’s saying, this matter would NOT have gone to court; Arlington Heating and Air Conditioning would not have LOST; and Croker’s company would not have had a Legal Judgment filed against them, a copy of which was then sent to the Better Business Bureau. He tries to minimize the fact that his firm, in fact, was SUED over this matter – and they LOST – with a sitting judge then slapping this company with a monetary Judgment. These are facts that no amount of spin, lies or blaming the customer can remove. Tommy Croker makes me puke. Seems he also doesn’t want you to know another fact . . . conveniently omitting in his detailed post that his attorney, David Roehrenbeck, who lost at trial, will file suit in Fairfax County Circuit Court if the post is not “immediately removed”. Roehrenheck’s letter is quite clear: “Unless you delete the Angie’s List listing and any other such listings immediately, I have been instructed (by my client, Arlington Heating) to proceed with filing suit in the very near future (for defamation) in Fairfax County Circuit Court (the level about District Court)”. Their sending such a letter, alone, says much more about how Arlington Heating does business than any post on Angie’s List, Washington Checkbook or anywhere else, ever could. One also has to wonder just HOW MANY OTHER TIMES HAS ARLINGTON HEATING THREATENED CUSTOMERS TO MAKE NEGATIVE REVIEWS GO AWAY? Maybe their ACTUAL rating on Angie’s List is a “D” or “F” . . . Who knows? What we do know is that Arlington Heating actively works to eliminate bad ratings through threats and intimidation. Every low rating they can get removed, their total rating (artificially) increases, rather than their actually working to earn positive reviews from happy customers. Our post is still there, see it? Here are more FACTS about what happened in this case: FACT: Our AC unit worked before Arlington Heating’s “maintenance” check. It never worked again immediately after their “maintenance check”. Croker claims, which he testified to under oath in court, that the subject AC unit was “prone to breaking down” anyway because it was 25 years old, “well beyond its expected life”. And, maybe so. But, their ace technician wrote in his service report that our AC was ONLY EIGHT (8) YEARS OLD. Croker spins this one away, too (or tries to), by claiming it was a simple “typo” (no kidding). Oops . . . Our former AC unit might still be working today if Arlington Heating and AC hadn’t “maintained” it, another fact. “Waaaaaaaaaaaah, not our fault, this customer’s AC was old anyway. Still, we at Arlington Heating investigated what happened and concluded that aliens broke their AC . . . Yeah, that’s right, aliens did it, not us. They zapped it with their laser death ray No, wait, a meteor hit this customer’s AC, that’s why it broke . . . Waaaaaaaaaahh. No, hold it, we were never even at this customer’s home, ever . . .”. FACT: Not only did our previously-working air conditioning system NOT WORK immediately after their “maintenance check” – they actually charged us for the service call which caused it to break, also refusing to refund any at all money paid in advance to renew a separate heating and AC maintenance contract on my father-in-law’s home. The service technician had just driven away with the newly-signed contract renewal when we turned on our air conditioning, or tried to. Thus, Croker and Company pocketed $110 for a service call which caused a working AC unit to never work again, IN ADDITON TO $220 hard-earned dollars paid in advance for the other contract – for doing no work at all to actually earn either fee. We know, Tommy, nothing is your fault, judging from how you dismiss every single negative customer posting on Angie’s List. “Waaaaaaaaaah.” FACT: I sued Arlington Heating over what happened, representing myself in court (I’m not a lawyer, happily, much too honest). Despite going against an experienced lawyer, David Roehrenbeck – Croker’s father-in-law – I STILL WON – even after Roehrenbeck had had the case moved from Small Claims Court, where I’d filed it, into Fairfax County General District Court (e.g. real court), and continuing it multiple times. I still won. The strict, no-nonsense District Court judge who heard the case, a former Marine, then slapped Arlington Heating with a monetary Judgment. I could’ve also received my legal fees – I didn’t ask for any – as well as more of my costs to file the case, which I also didn’t ask for. The $130 awarded out of the $480 sought (which probably worked out to about $1 for each hour I’d spent preparing for the trial), was donated to charity. Money was never the issue – NEVER. “Waaaaaaaaaaaaa. This customer bribed the judge . . . yeah, that’s why he won. Waaaaaahhh.” FACT: This company has been in business since 1944, that’s true. But 26-year old Tommy Croker took over in 2007 after the untimely death of his Dad, a total gentleman who built the family business, which Junior now runs, based on great customer service, trust and resolving problems to maintain long-term customer relationships. Perhaps Croker, Jr. will someday learn this. And, maybe not . . . their LAST FIVE CUSTOMER RATINGS ON ANGIE’S LIST includes two Fs and one C (as of this date) – no way to spin that away, either, see for yourself – and despite their supposed “100% Customer Satisfaction Money Back Guarantee”. “Waaaaaaaaaaah, this customer is such a meanie. He sued us. And, WE LOST. We had a lawyer and he didn’t, but the judge actually considered the facts of the case, waaaaaaaaaaah, that’s not fair. But, we only lost because this customer bribed the judge, waaaaaaaahh.” FACT: Their website touts: “Arlington Heating and Air Conditioning is fully licensed, bonded, and insured. Should anything happen while we are in your home, you are protected.” Huh???? Something DID HAPPEN in our home – the working AC unit Arlington Heating came to maintain no longer worked afterward – so what “protection” or “100% Satisfaction Guarantee”? “Waaaaaaaaaaaah, our guarantee covers customers if anything happens while we’re INSIDE OF THEIR HOME. This customer’s central AC unit was OUTSIDE of their home, which they knew, so they’re only trying to slander Arlington Heating by blaming us for causing their expensive AC to never work again after our “maintenance” inspection. Waaaaaaaaaaah, waaaaaaaaaaaaaah”. FACT: Mr. Croker notes a “100% Money Back Customer Satisfaction Guarantee” in his pathetic Angie’s List response. Huh, huh? We weren’t satisfied, obviously, and they still kept all of OUR money – for both the service call which downed our AC, and for the maintenance contract which we never used. More telling, again, their last five Angie’s List ratings include two Fs and a C. How can that happen with a “100% Money Back Guarantee”? Maybe this is why, in my opinion: “Dear Mr. and Mrs. Customer: We are sorry you are unhappy with how we serviced you. Please note that WE, however, are 100% satisfied because we have your money. Our “100% Satisfaction Guarantee” does NOT require that the paying CUSTOMER be 100% satisfied, so screw you, only that one party is 100% Satisfied. Please be advised that I will direct my father-in-law, attorney David Roehrenbeck, to file suit against you, too, if you tell anyone about this.” Tommy Croker makes me puke. Oh, I said that before. FACT: Arlington Heating is NOT top-rated by customers on either Angie’s List or Washington Checkbook.org, despite claims to the contrary. Their low 76% overall “approval” rating on Washington Checkbook is one of the LOWEST on the site for any heating and air conditioning firm. Nor are they top-rated by Angie’s List members, either, see for yourself. In fact, when contacted about Croker’s lawsuit, Angie’s List immediately wanted a copy of Roehrenbeck’s letter. Angie’s legal counsel then emphatically responded that Arlington Heating, or any company which pursues legal action over any Angie’s List posting, will be immediately de-listed, with an explanation on the site, in red letters, for the de-listing. FACT: Our decision to dump Arlington Heating and Air Conditioning was an educated, informed decision. And not just because my wife I are both Ph.D.s. We went with one of the many heating and AC companies which really are TOP-RATED on Angie’s List and Washington Checkbook, so it was a logical decision, too. EVEN BETTER, their bi-annual Heating and AC maintenance checks each cost SIGNIFICANTLY LESS than what Arlington Heating charged for the exact same service, and they value our business. A top-rated, customer-centered company costing much less . . . , go figure. As Angie's List advertises: "Bad Service? Report It!". We did. Croker and Roehrenbeck can both go to h***.
