This situation involves a customer who asked us to install work which knowingly would have: (a) violated City Code, (b) violated recommendations of the roofing manufacturers; and (c) resulted in long term issues for the homeowner related to performance deficiency and unwarrantable conditions. During these tough economic times, it’s hard to not give the customer what they want, but we are bound by industry standards and applicable codes. If we had installed the roof system as the customer desired: (a) the same type of problem which exists today would have re-occurred because the roof shingles are not designed or intended to be installed on such a low/gradual slope; (b) the work could not have been warranted as it would have violated Code; and (c) the customer, as a future seller of the property, would have been duty bound to make a full disclosure of the known code violation, thus materially hampering her ability to market and/or sell the property with that material defective condition. With that being said, we appreciate the feedback we were given of her experience with our organization. On behalf of our TEAM, I regret we couldn’t exceed her expectations; but based on the circumstances, we are confident we handled the matter professionally. So there is no confusion of the chronology of events, we have outlined the facts below: 1) BELDON was contacted on January 8, 2009 @ 10:26AM and assigned Lead #140662 (assigned by address and not owner’s name as an owner’s change from time to time and not necessarily the physical address). Further, BELDON did not solicit the work or induce the customer to sign a contract with us. 2) In response, and within 24 hours, we placed a call to the number we were given, and it was this member’s; contact was made and an appointment was set, at a convenient time for her, on January 16, 2009 @ 12:00PM 3) Chuck Hood, our Sales TEAM member assigned to this project has been with our TEAM since 1983 and we have not one documented complaint from anyone in the 26 years Chuck has been with us about his professionalism or competency, as a member of our TEAM. 4) The leaking section of the roof, in question, has a slope of less than 2:12. It is AGAINST Code to install the roof in the manner in which the owner requested. A copy [of these codes] can be obtained from the local code compliance office. BELDON recommended a system designed for low slope applications. Unfortunately, the shingles requested will not work and this is the reason it’s creating a problem on this newer home. We still stand behind our professional recommendation of installing a different product.
