ELITE FENCE & IRON WORKS

Elite Fence & Iron Works failed to perform under signed contract. On June 2, 2008 I sued Mr. Shelton and obtained default judgment in the amount of $1,158.84 in Precinct 3 Place 1 of Collin County Small Claims Court. I (plaintiff) entered into a contract with defendant Bill Shelton (a convicted felon) owner of Elite Fence & Iron Works to replace retaining wall at rear of residence in Plano, TX for an agreed upon amount of $3,480.00. Signed contract on 9/27/2007 and paid $1,158.84 down payment. Shelton promised to start work within 10 days and complete project within 3-4 days. 42 days and numerous excuses later, Mr. Shelton had set only 2 posts and refused to complete the work as agreed unless I paid an additional $400. I refused and sued Mr. Shelton in small claims court. Mr. Shelton failed to appear and I was awarded a default judgment by the court.

We hired them on March 11th to do the work. Since then (it is now May 3rd) they have only performed about 16 hrs. of work. The frame is up for the wooden fence and that is all. When we call they say they are waiting on materials or that they will be out the next day, but never show up or bring any supplies. We are continually getting the runaround and lied to. We have asked them for either give the money back or a completion of the work since already paid them $2625. They keep saying they want to do the work then just don't show up.
