Description of Work: > > Subject: Re: Construction of Patio Extension > > > > Date 18 April 2011 > > On 20 March 2011, I signed a construction agreement to have DFW Cedar Construction construct approximately 600 square foot of concrete patio to join the existing covered patio at the back of our residence - 2128 Stoney Gorge Road, Fort Worth, Texas 76177. The agreement called for the patio to be completed within 10 days from issuance of a permit from the City of Fort Worth. The permit was issued on 30 March 2011. > > A week passed before an initial inspection by the City of Fort Worth and clearance for construction was given on 5 April 2011. Another week passed before another inspection by the City of Fort Worth was performed on the excavated area; the inspection took place on 12 April 11. The excavated area was found to be satisfactory by the inspector. Since the excavation was completed, no further work has been accomplished; leaving the back yard of our residence in an unacceptable condition. > > Checks were issued to pay for the construction in the amount of $1,000.00 on 20 March 11, $1,200.00 on 1 April 11 and $1,100.00 on 12 April 11. The value of construction to date is approximately $1,000.00 based on the man-hours at the residence of 8 hrs x 3 labor = 24 hours of effort to remove topsoil and trench to 12” of depth for 20 linear feet. > > There was some rain on 5 and 12 April, but the rest of the days were clear, hot, dry and windy. > > Unfortunately, your company has not performed well as evidenced by the lack of construction progress. I am disappointed because of the construction delays and long duration to complete in what are your words, “A simple project.” > > I sent an email expressing my concerns about some disturbing information I found on DFW Cedar on the internet on 15 Aril 11, resulting in your call to me on Saturday, 16 April 11. > > During our phone call on Saturday, 16 April 2011, you explained the reason for delays, citing permits, cost of fuel, and weather as reasons and promised to be fully engaged on Monday, 18 April 11. I even left my vehicle parked in the street to accommodate sand that you said would be delivered. > > To resolve the problem, I would appreciate your provide me a schedule of when materials will be delivered, concrete poured, and the decorative finish will be applied. I also need to see what your engineering plans for relocating the two sprinkler heads, providing access to the sprinkler controls, and drainage are. > > I look forward to your reply and a resolution to my problem and will wait until 21 April 11 before seeking help from a consumer protection agency or Better Business Bureau. BBB was contacted on 27 April and they sent the complaint to DFW Cedar Construction and gave them time to respond to the complaint, 22 business days. Today is May 29 and we have not heard anything. Email from 9 May - I know I am starting to sound like a broken record, but another week has gone by and still no significant progress has been made toward completing the patio that was promised to be finished in 10 days. When I say a week, I mean seven days with sun. Please get this done while we have favorable weather... Email sent on 27 May - We have not heard anything from you in quite some time. Actually, we never hear from you directly; only in response to our query and then it is very cryptic. Since we have had quite a few sunny days, we were expecting to see some progress on the patio. We are trying to understand why it is taking so long and would like to hear from you something about when you expect to get this project finished. We have upheld our part of the contract by paying up when you asked. We want to have this done by the end of May since we have been dragging on since the 1st of April, almost 2 full months. Waiting for your response. The Grant's My wife tried to call at least 3 times on 27 May. I have called many times as well, and can get a record of the calls. The company never initiates contact and rarely responds to us. Once they said that they do not respond because it can be held against them. Thanks The Grants.
