Description of Work: Gutter Cleaning

Description of Work: Signed contract with roofing company on June 20, 2012. Work to commence 06/24/20. Roofing contractor showed up with two men and supplies consisting of a few rolls of roofing felt and a box of nails on July 2. The two men worked on tearing up roof and applying felt for 2 days and the roof was not touched again. The two men crew threw old shingles onto yard grass. Contractor contacted to come and pick up old shingles before grass burned underneath. On July 8, contractor shows up with two men in a pick-up and they load and carry off shingles. At this time, contractor was approached on why it was taking so long to do the work. He apologized and promised to make it good. This was on a Sunday. He promised to return following day, a Monday, July 9 but there was a no show all week. E-mails were sent and phone calls left but no response. On July 12, a certified letter was sent him advising his contract was terminated effective Friday, July 13 if again no show. On July 13, contractor received and signed certified letter as received. Another contractor was approached to complete the roof and on July 16, 2012, a different contractor completed the job. Since then, a complaint was filed with Texas Attorney General and with Better Business. In the complaint, I requested the return of the $3500 paid him and receipts of any supplies he used for the roofing felt so we could deduct these from the $3500. No shingles were ever delivered from this contractor thus the expenses have been minimal and most of $3500 was basically been stolen. Thus far, roofing company has failed to respond. The next step is the filing of theft and fraud charges in Small Claims Court in Rockwall County.
