epoxy flooring, stamped concrete

I will start off by stating that Donovan did come back 2 more times after the initial job in an attempt to fix the problems. Unfortunately, the lack of detail by him and his crew left us with a terrible finished product. The overlay was the biggest issue. No one seemed to truly know how to do an overlay correctly. At Donovan's suggestion, we did an overlay right over the top of the existing ceramich tile. I have 5 pages of hand written notes so I will highlight the biggest issues. Attempt #1 Sept 3rd *Grout lines were still visible by both touch and sight. *lump of concrete overlay in middle of bathroom floor. *different shade and sheen within overlay *We originally choose 4 colors. Donovan changed it to 2 other colors, but never gave me those colors. He said they were a different brand so he wasn't sure at the time. *Corners of room were not sprayed. *Nail holes from carpet tack strip were not filled. *Overlay border was rough and uneven in some areas. *No materials or instructions were left for waxing. After I both called and emailed Donovan, he agreed to meet with me on Sept 9th. He never apologized for all the issues, but was polite. He assured me everything would be fixed and that he would personally be there. Attempt #2 Sept 10 *Border and overlay was so rough that it ripped the mop when I tried to clean them. *Rear entry overlay was really dark. Color had been applied with a rag. *Epoxy was so uneven that some areas were rough and dry while others appeared to have standing water. *Many nail holes remained. *Color was added to border, but no epoxy was added to protect it. *Donovan was there in the morning and again toward the end of the day, but gone for hours in the middle. *During our meeting, Donovan agreed to buff all floors to smoothe out any rough areas. When I asked about this on the day of the redo, Donovan simply got on his hands and knees and wiped a small area with a rag. *He did leave a microfiber mop this time, but no wax or instructions were left. After I sent a few emails and a voicemail was left, Donovan agreed to meet again on Sept 23. He was again polite in person. This time he agreed to chip out the overlay and remove all the ceramic tile underneath since the overlay areas looked so bad. He suggested using a pigmented epoxy paint over these areas to keep the grout lines from showing through and on all the border. He gave us a color chart and we picked Brick Red. We confirmed this color again with his crew the following day. Attempt #3 Sept 24 *Day 1-Overlay was removed from bathroom and rear entry. A new overlay was applied directly over foundation. Borders were sanded down. *Day 2- Epoxy paint was applied. Wrong color was used. We asked for Brick Red, they used Seattle Red. He had warned us epoxy paint would have more shine to it, but this was the extreme. Everything reflected in it. Sunlight, the door, mirror. Everything. It was also filled with air bubbles, hair, and dust. The high shine only made it more obvious. It didn't come close to matching or complimenting the main floors. *Again, no wax or instructions were left. *Day 3- Donovan came back alone while we were at work to apply another coat of epoxy paint. We sent him a message that morning about the wrong color being used. We again asked about the wax. We also marked a couple of spots with painter tape where there was long hair stuck in the epoxy paint. Donovan simply scratched the shine away. The hair remained and now it just had a dull spot in the middle. He never acknowledged the color issue and said he would get back to us on the wax. *No instructions of any kind were left. I sent him a text later that day asking for instructions. Specifically, could we walk on the overlay areas and when could the floors be cleaned. He suggested staying off them for a couple days, but to be careful for week. That was the last time he was in our house. When I got home from work that evening and saw his finished product, I actually cried. I couldn't believe we had wasted our money on that. The main floors looked okay if you didn't look closely. The color had begun chipping off in multiple spots and it scratched easily. We did corespond with Donovan a few more times via email and text messages. He never showed us how to wax the floor nor did he provide the wax. He finally sent a text saying to get a bottle of high traffice wax at Home Depot. I sought the expertise of multiple companies and several of them came out. We were desperate for an affordable solution. They were all surprised by what we were left with. Everyone asked if I had paid him in full and if this was his finished product. (yes to both) In the end, we had to hire a flooring company to lay new flooring. The overlay and some of the border had to be grinded up so the new flooring would adhere. The new floors were installed 10/31/13. Almost 2 full months after this fiasco started. We had to wait until we could save up and pay for the floors all over again. Sometimes he would respond to us and sometimes he would ignore us. I asked for the colors on 3 occasions. He never gave them to us. He provided some product info, but never the actual colors used.
Description of Work: We hired Donovan to dye the concrete and apply an epoxy sealer in 2 living areas plus apply an overlay and dye for the bathroom and rear entry. We also agreed to an overlay border all the way around both rooms to hide where the carpet tack used to be. Donovan agreed to provide us a mop with large bottle of wax (enough to do 2,000 sq ft) and show us exactly how to wax it the first time. All baseboards, carpeting, and tack strips were removed by us.
