Signed a contract for our first home to be built by Martin Villanueva Construction, LLC on April 30, 2010. The first problem is that we did not have a realtor with us, we went on our own, because of this they were not going to pay anything towards closing cost. Zero! Untill our Loan Officer and my sister who is a Loan Processor said that was wrong. They fought it for me and finally got the builder to put down some money towards closing cost. Due to dispute in price they were told on buying the land they were going to build our house on, construction was delayed untill June 2010. At first everyone seemed very nice. We were excited about our new home untill we started seeing the end results.The kitchen, bathroom cabinets that were built were to be stained a dark cherry wood instead they were spray painted a dark brown to look like dark cherry wood. Our brand new garage had a crack in the foundation going from across the room, most of the outlet switches for lights and electrical outlits were crooked, the window sill's in the front living room and dinning room were cracking in the middle, the back patio was not leveled correctly so when it rained water would pull up on one side of the patio. We could have delt with everything but when we saw the crack in the foundation in the garage that was the last straw. We could not see ourselves buying a new house that already had a crack in the foundation. So we called Villaneva Construction to let them know. We took them to small claims court to get our $2000.00 earnest money back due to the house was not completed by the contract date which was July 31, 2010. The house was completed the middle of August. The most disturbing thing is that they did a complete 180. They told lies in letters to us stating we had delayed the project. They claimed they had tried to contact us several times and could never get a hold of us, that we dalayed because we took awhile giving them the tile info ( which I have email's proving we sent them all the tile info months before they decided to finally go get it and then it was sold out), light fixtues, final inspection, and permanent light service. The crazy thing is that while building the house they wanted us to call the electric company put the light service on in our name so they can get the inspection. At first I aggreed because I wasn't sure how that was handled but that day after thinking about it I called them the next day to tell them I did not feel comfortable putting the electricity in my name when we didn't even own the house yet. The house was still being built which means I would have to pay for all that electricity and didn't even own the house. They did have to redo the roof due to me because when I saw the frame of the roof it was not how I wanted it. Supposedly the floor plan I had picked was not the roof I wanted. The very next day it was fixed. Not sure how one day delayed months of delays. We had our court date with every single email I had saved proving there weren't any dalays on our part and pictures of the house. Our case was due to the contract it states if the house is not completed by contract date (July 31)Seller would be in default and buyer receive earnest money. The judge did not see it that way. He ruled in their favor without seeing any pictures or emails. I thought our contract would have seeled the deal but it didnt happen that way. It is too late for us but if this can help any one else I would be happy! The worst thing a company can do is lie, I lost all respect for that company because of their lies. I have saved all my email's and pictures to prove them in their lies. Most important always have a realtor. Good Luck!
Description of Work: In June 2010 we saw homes that were built by Martin Villanueva Construction on Parade of Homes. The homes were set at a good price so we decided to have our first home built by them. We signed the contract April 30th 2010. Construction started June 2010. Apparently they were having a problem with the closing on the land they had purchased to build our house on. There was a dispute in price they had been given originaly. This delayed the construction of our house. The contract stated the closing of the sale would be on or before July 31, 2010. The house was not completed by that date and the construction of the house was horrible. The garage had a crack in the foundation, mostly all the outlit switches were crooked, the back yard patio was not leveled, when it rained water would puddle to one side of the patio, the wood trim on the widow sill inside were cracking, they kitchen and bathroom cabinets were to be stained a cherry wood but instead were spray painted a dark brown to kind of look like cherry wood. In all we were very disappointed in how our first home was being built.
