We hired CJ Contractor Services to install 12 x12 ceramic tile in an offset pattern and floating laminate flooring throughout our first floor. They gave me an estimate based on my rough sq footages (approx 800 sq ft of laminate and 300 sq ft of tile). Their estimate for $1625 ($1000 for laminate and $300 for the tile plus their service fee) was in-line with other bids I had received. However, I requested that they send someone out to my home to verify the measurements, check to see if any leveling would be needed and any other items that could affect the cost prior to signing a contract. Carrie (the Vice President) came out to my home with a sub, I had already removed furniture and the existing flooring down to bare concrete. They measured all of the rooms and used a 10’ long metal level to check to see if any areas would need to be leveled for the laminate installation. They found the Entry way and Living Room would need leveling and agreed the total cost to level these areas would be $200. Carrie asked to use my home phone and made a phone call after which she informed me the total cost for the installation of the tile and laminate would be $1699.13. She confirmed this price included leveling for the Entry and Living room and her contractor fees. She said they would be able to start work the next day (Friday Aug 10th). It was at that time I gave her a deposit of $849.77 for half the cost of the job and signed the contract for the work to be done. On Friday the laminate installers arrived and were able to install the laminate in one day. They did an adequate job but I voiced my concerns to Carrie in regards to two areas (one in the Entry and one in the living room) that did not appear to have been completely leveled as they should have been per our contract. She said Joseph (the President) would come out Saturday morning to look at it with the tile installers to start the work for the tile. Saturday morning Joseph arrived and it was at that time he informed us he would be doing the tile installation himself. He did not bring all of the necessary equipment with him (ie the correct tile saw, buckets, mixers, sponges etc) so he informed us he would go pick up the items he needed and come back to start the tile installation. We had already moved all of the appliances and everything out of the kitchen and utility room prior to his departure and so we were under the impression he would be back in a short amount of time to start work. We waited several hours and Joseph never returned. I made several attempts to contact Carrie via phone to find out where Joseph was and to discuss my concerns about Joseph installing the tile himself but was unable to reach her. We finally received a phone call from Joseph and Carrie that evening and it was then he informed us he was choosing not to complete the tile installation. We agreed that I would pay them $400 (which is in addition to the $849.77 deposit they already received for a total of $1249.77) which was to be the final payment and balance due for the laminate installation and that I would find someone else to install the tile. Joseph came back that evening to pick up the bags of mortar and supplies that he left at our home and I gave him a check for the $400 per our agreement. It was our understanding that when he accepted the check for $400 as final payment for the services rendered we had completed our contract with CJ Contractor Services. However, Joseph is now demanding we pay an additional $200 for the leveling in the Entry and Living rooms even though this amount is clearly listed as part of the original contract. Joseph has also yet to address my concerns with the areas that are not adequately leveled in the living and entry . CJ Contractor Services has also stated that they will be paying the laminate installer $1121.33 for the work he completed (including the leveling) on my job so my payments to them totaling $1249.77 completely covers this amount.
Description of Work: Contract was to include Installation of floating laminate flooring and ceramic tile. But only the laminate flooring was actually installed by CJ Contractor Services.
