company took prepay for pool maintenance and then did not show up

We have filed a lawsuit against this company. Things started well but quickly went down hill with one problem after another. Contractors didn't show up when promised, and we felt we had to supervise the work every step of the way to ensure things were done per our agreement. It also became obvious late in the process that Aquatic was having financial problems. In fact, we received notice of a mechanics lean on our home because one of the contractors still hasn't been paid for their work. We know they're not the only ones, but they are the only ones seeking a legal remedy so far. Also, getting the final items finished on the pool, like cap rock on the waterfall, repair of the return on the beach entry, installation of a regulator on the gas line to the pool heater, and caulking between the coping and decking took numerous phone calls and threats of legal action. Finally, the set up on the pool wasn't done correctly. We're spending a lot of time ourselves getting the chemicals correct.

The pool was built in only three weeks from start to finish. This includes removing the trees to make room for the pool. The actual construction went smoothly, but there were a couple of problems right away. The pool tiles were put in off line. You can tell this because the water is always level. There were also some small cracks in the plaster. They repaired all of this, but it took some prodding from us do get it done. Still, the experience was mostly positive.
