I entered into a contract with Dewey Simpson of DSI Enterprise on August 15, 2018. Per our contract, I was to pay DSI Enterprise a $20,000 to begin full home remodel which was to include plumbing updates, foundation repair, privacy fence, complete kitchen renovation, complete bathroom renovation, window replacement, refinished walls, paint and attic cleaning with insulation. Once all updates were complete with the exception of the floors, I was scheduled to pay an additional $20,000. In the agreement, payment was not expected to be made again until everything was completed with the exception of the final hardwood floors laid. The expected completion date was November 1, 2018. As of December 18, the project is only at about 30% completion. The only items that were in scope that were completed on time were the foundation (which was subcontracted by another company), plumbing and the hot water tank relocation. This entire project was scheduled to be completed by November and not one single room in the house has been completed. On October 22, DSI Enterprise requested another payment of $18,000. He ensured that the project would be completed by November 15. Since we were nearing completion, I agreed to pay $14,000 of the $20,000 ahead of schedule. When we reached November 15, I was then given a move in date of December 1. He continued to blame weather as the reason that the date was being pushed out. There were several times that I would stop by or have my real estate agent drop by the work site and no one was there. On November 25, Dewey Simpson requested that I take four hours off work to pick out tile and flooring. I picked out all tile for the bathroom. He then said that the project would be completed before Christmas and he was confident that he project would be finished by then. On December 7, I expressed serious concern regarding the project. At this time, Dewey Simpson stated “he was sure” the project would be completed by Christmas. During our check in on this day, the only items inside of the house that were complete were the plumbing and some electrical rewiring. The electrical work was not in scope, but I agreed to pay Mr. Simpson $1,750 for this work. Considering this was out of scope, I agreed to pay for my hardwood flooring totaling nearly $4,000 and we would remove $2,000 from the budget. On December 14, Dewey Simpson requested yet another payment outside of our agreement. I told him that I refused to make any more payments until I see progress. He then agreed to ensure to finish the bathroom and two bedrooms over the weekend. I have witnesses that heard him agree to this. On December 17, I arrived back at the home and the bathroom was completely undone and the bedrooms were still under construction. As of December 18, here is the current status of my first home: Window replacement: Major issues with windows. Contractor attempted to cut cost by using in stock windows rather than measuring for custom windows. Windows were supposed to be started following foundation repair that was completed on 9/23. Windows in the back of the house were replaced with in-stock windows with grids. Contractor did not consult with homeowner before window replacement. Asked for low-e gridless windows to be used for project. Grided windows were not replaced. On 11/16, contractor took out two entire windows and replaced it with one in stock window. Communicated that this was not acceptable. As of 12/17, none of the windows has been satisfactorily completed. Windows in the kitchen have not been touched. Window in bathroom was installed broken and window framing is crooked. Two in stock windows in front of house were installed, not the window unit that was approved by homeowner. Contractor also stated window units for front of house had been ordered from Home Depot, yet still put in different windows. Kitchen windows and front right window remain untouched. Floors: On 8/15 contractor stated floors could not be salvaged. Received outside opinion that floors could have been refinished. On 11/25, contractor requested homeowner to take four hours off from work to pick out flooring and tile because he needed to have it "at his disposal." As of 12/17, flooring cannot be installed because rooms are not finished and subfloor has not been laid. Homeowner purchased $4,000 of flooring and asked that the budgeted funds for flooring be removed. Agreed to have $2,000 removed from overall cost of renovation. Walls: As of 12/17, some walls have been skimcoated but quality of work is bad. Walls have scratches, holes and dings. Received an assessment from another contractor that stated walls should not be painted because additional layer of skimcoat was needed. Kitchen: To date, the only thing in the kitchen that has been completed is the water line for the refrigerator and the attic door modification. Homeonwer asked for this to be smoothed out to blend in. It was the contractor's decision to move to the bedroom. This was quoted in scope. Demo has not even been completed. The kitchen was supposed to include: Soft close cabinets and drawers, hardware, time, shelves, countertops, installed appliances. Bathroom: Full demo and subfloor in the bathroom was not completed until 12/15. The bathroom was supposed to include shaker style vanity, bathtub with shower and linen closet update. To help alleviate budget strain expressed by contractor, homeowner purchased all items totaling more than $1,100 for bathroom (vanity, lighting, mirror, tub, shower fixtures). Contractor only purchased tile. He also purchased the wrong tile for wall and floor. Incorrect tile was installed on wall. Also, contractor stated that he took delivery of damaged tub and begin installing it. Tub is damaged in several places. Master Bedroom: Bedroom to include new walk-in closet, and closed off door, plus other items that have been requested throughout the home. New front window was installed on 12/16. Job was rushed. Contractor claimed to have ordered window unit, but instead installed two separate windows. Second Bedroom: Bedroom should include other items requested throughout home. Not completed. Walls are rough and have not been finished. DSI Enterprise has stated that they will not finish the work and I’m left with a ruined house after paying Dewey Simpson $34,000.
