The deck required, and I was specific up front, special repairs. After working on the deck for several days, he came to the conclusion that repairing the deck would cost more than initially bid for and I agreed to that. No work had been started on the exterior wood trim. I expressed that there was no difference shown in the work that required the additional funding, and that I would not have approved it, had the challenges been properly communicated, he became angry and said he already had more into the job than he estimated. He stated that he quoted this part of the estimate low knowing that the total job was larger. That was never communicated to me until he said that to me. He left the job that day without communication with all of his equipment and tools. The construction trash was left and the job was not completed. He had not even started on the rest of the project. When I called him, he said he didn't think he could make me happy. So I said we could part ways and that I would still pay the additional amount he quoted for the deck. After subtracting out the 50% down plus the additional owed, an amount of $750 was due back to me for the deposit for the exterior wood trim work. I stated that that was the amount owed to him and he agreed to come back the following morning to complete the dog ramp and haul off the trash. He did not return. I called and left two voicemails. I did not hear back. So I left a voicemail and sent an email and written letter through USPS stating verbatim what I said in the voicemail asking for the funds owed to me. Also stating that if he needed more time to communicate that to me. There has been no response as of this date, almost one month later.
Description of Work: Texas Pride required and I paid a 50% deposit for repairing cleaning and staining my wood deck. This deposit also included replacing and painting the exterior wood trim on the house.

I met with Mrs. (member name removed) and she showed me everything she wanted done which included the exterior siding, deck repair and stain, remove a wall in her kitchen/dining room, complete remodel of the hall bathroom, install an exhaust fan and recessed lights in the master bathroom, recessed lights in the dining room and possible refinish the wood floors. I prepared an estimate for all work to be performed and provided Mrs. (member name removed) with 2 referrals. I received a call from Mrs. (member name removed) and she informed me that she had two other estimate and that I was not the highest and I was not the lowest and she would like to go with Texas Pride Exteriors and wanted to know if I could meet with her and go over the ideas for the interior. I met with Mrs. (member name removed) and we discussed the kitchen/dining room wall and she was not sure about how she wanted to finish out the wall was removed. She told me the price for the recessed lights was too high so I lowered this price to an agreed price with Mrs. (member name removed). I also told her I would fix her water damaged hall ceiling and paint if for no charge. We then discussed the wood floors and refinishing them and Mrs. (member name removed) told me she was concerned about repairing and refinishing the wood floors because of her dogs and the dust. It was at this point in our negotiations that she told me at this time that she did not get along well with contractors and that she has had bad experiences with prior contractors she hired. She then told me she would like to start with the exterior repairs first. I agreed to this and I took the total for the exterior repairs without the overhead and profit and wrote up a new contract for only the exterior repairs and took half down payment which is my standard. A history of the house. The master bedroom is an addition on the home. There were significant foundation problems in this area that affected the addition and the attached back deck. When the foundation was repaired, the back deck was not repaired with it and has remained in a settled position that is much lower than the addition foundation. When I prepared my initial estimate for the whole job including the interior work, I basically threw the deck in as a favor with a price of around $450.00 due to the size of the complete, total job. I noticed that Mrs. (member name removed) got upset with me the first morning because I showed up with one of my workers to go over the exterior repairs with him. We were about ten minutes earlier than I had told her and she was not happy about this. This was the first time I had upset someone for being early. I started working on the deck and started noticing that as I would level one area of the deck, another area would be affected. I checked the piers of the deck and discovered that the deck had fallen off of the piers that were attached to the foundation of the addition. I informed Mrs. (member name removed) that I would have to charge her an additional amount because I was having to spend more time on the deck than anticipated and I had not charged her very much to begin with and I explained to her the reason being due to I had basically thrown the deck in at a reduced amount in consideration of the size of the total job. Mrs. (member name removed) did not seem to understand this. As we continued to work on the deck and the foundation of the deck, Mrs. (member name removed) became more and more unsatisfied with everything we did even though we were doing additional repairs to the deck such as adding extra braces to the bench seat and revised the plumbing clean outs and added access hatches to the clean outs. I explained to Mrs. (member name removed) that in order to make the deck perfect, it would have to be totally rebuilt with a new foundation. It was not going to match the foundation of the addition after the addition had been releveled and the deck was not releveled. Mrs. (member name removed) did not understand this either and told me once again that she did not do well with contractors. We were unable to do anything to her satisfaction. It got to the point that my workers were walking off the job site and I had to convince them to continue working and to not let Mrs. (member name removed) offend them. I finally came to the conclusion that we were not going to be able to satisfy Mrs. (member name removed) no matter what we did. We built a new dog ramp for her two dogs and it was 2.5 inches wider than her old one so she made me take the ramp apart and rip 2.5 inches off and put it back. This was the point that I made the decision to cut my losses and not return to Mrs. (member name removed)'s residence. I called and informed Mrs. (member name removed) of my decision and she wanted a portion of her money back. I informed her that materials and labor had already amounted to more than her down payment. I did not want this job to turn out as it has and I feel bad about it but Mrs. (member name removed) needs to understand that there are limits to what can be repaired and sometimes to make something perfect, you have to start over with it. I believe she had trouble with her neighbor who did some work for her also. Throughout the time I spent with Mrs. (member name removed), it was evident that she will not make a decision on her own. She always had to call two people and run it by them. This makes it difficult to progress on a project when you are waiting for 3 people to make a decision. In all honesty, I was glad we started on the exterior and I got to see how it was going to go with Mrs. (member name removed) before I started on a major bathroom remodel. I wish the best to Mrs. (member name removed) and hope she finds a way to deal with contractors so she can have the house she wants.
