Brick & Stone Pavers LLC

We contracted with Fernando Magal/Magalhaes in March, 2015 for a very substantial project. We recently found that although he told us his last name is Magal he used the name Magalhaes on documents filed with the State of Texas. We also recently found that the company name he uses, Brick and Stone Pavers, LLC, is a forfeited LLC since 01/2007 due to tax non-payment according to the State of Texas records. We also recently found that the 'office' address he used is a postal service drop box. Had we known these things at the time we never would have contracted with Mr. Magal/Magalhaes. He wanted a 40% down payment in order to buy all of the pavers required for our project. Sadly, we paid it. He/his people did about 2 to 2-1/2 weeks work maximum on our project and then started making excuses for not coming back out. We begged, pleaded and cajoled to get him back out but nothing worked. He has avoided us repeatedly and his communication has been abysmal. At this writing (07/27/2015) it has been about 2 months since he has been back out to do any work. We are now well over twice the 60 day contractually agreed time frame for completion. He has made promise after promise to resume work but his many promises have meant nothing. Now, he has a lot of our money and has done very little work. As well, we recently learned that he did not buy our pavers as he promised at the beginning of the project and as he told us several times that he had. Unfortunately, legal action is our only option at this point. I am sure that he will make many more excuses for this review and will try to turn things around and say what bad people we are. And, if you meet him, I am sure you will find that he is very personable, seems genuine, and is a good salesman. But all we can tell you is ... Let the Buyer Beware!
