In October 2011 we engaged Remax Realtor Roland Graves to help us find a Home with Acreage in the Brownwood Texas area which is approximately 280 miles from the area we were moving from. After looking at several and he got an idea of what we were looking for he called us one day to let us know about a new Property that his Office had just listed. He told us this Home was a " Approximate 20 year old Site Built Log Home on Pier and Beam, that it was brought in as a kit and erected on the Site" in other words it would have been considered a Modular Home and even gave us some Brochures on such Homes to described them better to us. He also told us that there was a Serial # on this House listed at the Court House but that this was not a Mobile Home which Serial #'s are usually associated with but that these type homes also had serial #'s on each Kit. After our offer was accepted we requested he sent a Inspector out to inspect the Home. The inspector referred to this home as a Double Wide Mobile Home in his Inspection. After calling the Inspector myself and asking him about it being a double Wide Mobile Home and telling him that it was supposed to be a "Site Built Log Home" he replied that he had thought it was a Double Wide Mobile Home. I called Mr. Graves to ask him about this and told him that we did not want a used Double Wide Mobile Home that if we were going to go that route we would want a Brand New one since they do not ever appreciate in value. He assured us that it was absolutely not a Mobile Home that most have just never seen these type of "Kit--Site Built Log Homes" and probably did not know the difference. He also presented this House as a "Site Built--Kit Log Home on Pier and Beam" to the Lender we used and also to the Bank we were originally going to use for financing so this ended up being financed just like a regular Home not Mobile Home Financing. Once we were moving in we proceed to find the Water Heater because that is the only Appliance on Propane, everything else is Electric and I wanted to check and see if we could possibly get an Electric one. We could not find it anywhere and finally my Husbands Friend found it on the outside of the Home inside a little closet type door just like the older Mobile Homes had---[I know this because my Dad had one about 40 years ago but the new ones have the Water Heater inside just like a House--usually in the Laundry Room.] This got us suspicious and my Husbands Friend offered to crawl underneath the Home to check it out further. When he returned he was shocked and stated that this was definitely a " Double Wide Mobile Home" that the Wheels and Tongues had been removed and then it was sided with Logs. Also turns out this Home is between 28 and 33 years old not approximately 20 years old as Realtor had stated according to the age and Seriial # of the Water Heater alone. Since we are very unsure of what to do at this point we have now had to hire an Attorney for help on this Fraudulent Sale. We cannot see having to pay 156,000 for a very old Double Wide Mobile Home which was totally and deliberately misrepresented in order to bring the price up is in need of remodeling and is not worth anywhere near that amount even with remodeling and 8 acres and we do not care too much about having to live in one. For that kind of money we could have bought another 8 acres and a Brand New Modern Modular Home with possibly money left over. We are certainly hoping that Remax will fix this huge mess and take appropriate action against the Realtor that misrepresented this property to us and quite possible also the listing Realtor which is also one of theirs. Update 7/5/12 We have filed a lawsuit against Roland Graves the Realtor and Remax and this lawsuit was filed in Brown County Texas on June 14/2012. Our Attorney has filed on 6 different counts--Count 1: Common Law Fraud--Count 2: Fraud by Nondisclosure--Count 3: Statutory Fraud--Count 4: Negligent Misrepresentation--Count 5: Breach of Judiciary Duty--Count 6: DTPA Claim. So far we have not heard anything back from Remax or their Attorney so I while we are waiting for an outcome we will gather all of our records and also be filing a complaint with the Texas State Real Estate Commission and see who we need to contact about filing Criminal Charges for Real Estate Fraud. We now also have a copy of the original title from the original owner stating that this house is indeed a 30+ year old doublewide trailer and the origianl owner told us herself that her late husband and her bought this trailer in the early 80"s and moved it onto this land, then removed the wheels and axles and sided it with rairoad ties. Update 7/6/12 Today we received a insulting offer from Roland Graves/Remax Attorney--1,500 total, 1,000 for alleged economic damages and 500 for attorney fees incurred to date. So far we have spent 4,500 with Attorney alone. Their Attorney does not think that there is a substantial difference in a site built kit/modular home and a very old trailer house. Who is he trying to kid? Here we are 1 1/2 years later and all is still up in the air even though our Attorney says we should be going to Court on the Civil matter by around September/October, I just found out today that the Attorney with the Texas Real Estate Commission has not even started to work on this case even though their Investigator finished her Investigation months ago and just now find out that I need to go to the District Attorneys Office here to get them to file Criminal charges against Goldstar/Remax--Roland Graves, Stan Crawford and Toby Piper. I am sure they will send me to the Police department where I will have to make out yet another report. If they do not file charges against these Criminals and get them indicted very soon I am going straight to the Media with our story and I will make sure that everyone in this Town and surrounding area knows what they have done to us. Apparently we are not the only ones that have had problems with Stan Crawfords Real Estate Office, we have met another Lady who has also had many problems with them. I have been encouraging her to also file a report with Angies list and other Agencies.

Update 10/9/13: Remax/Goldstar has now changed their name to TEXAS GOLDSTAR and the Texas Real Estate Commission Attorney is working on the case to determine if they will lose their licenses and or receive fines. We have also found out from the previous owner who had this property and sold it to the people we bought it from that Toby Piper was also the Sellers Agent at time and he was very aware as long as 5-6 years ago that this is a Mobile Home and in order to obtain financing represented it then as a Modular Home since no one would do a loan on it as a Mobile Home. Lawsuit is scheduled to go to a Jury Trial approximately January 2014.
