We have had another contractor give us an cost estimate of the work Martel completed. It was $16,000. This was before we learned that the subfloor had to be redone. So we are out $30,000 plus the cost of redoing the subfloor.
Description of Work: On October 10, 2010, we signed a contract to have a modular beach home built. We made intial payments in the amount of $46,000. and this was to cover the engineering drawings, permits, WIP inspections, materials and labor for the pilings and subfloor and the purchase of the SIP Panels (walls - the largest cost). The contract stated the home would be substantially completed by Jan 15. However, by that date the building permit was not even obtained. Shortly after that Chip Martel did obtain the permits and install the pilings and subfloor but he did not have the WIP inspection engineer approval. We later learned that the subfloor did not meet the inspection requirements and would have to be redone. Then at the beginning of March, Chip Martel stopped work on the project for many personal reasons: spring break, death in the family, other work to finish. We tried to be as accommodating as possible. We asked for him to give us another timeline that was reasonable to him, but he never did provide this. He had our money for the SIP Panels months but he never ordered the SIP panels. We asked for that money back until he was ready to order the panels but he refused. On March 28, he sent an email saying he would not continue the project - he quit the contract. He said that he would provide an itemized list with the refundable portion. He never did. We asked for an itemized list 6 times by email and also on the phone. He never provided this or any refund. We made arrangements to resolve this thru the Dispute Resolution Center (part of the BBB). He canceled all 3 of the arranged meetings. He ignored requests by our attorney. After learning of my last review, he called irrately to say that we would never get a penny back.

The contract stated that the house would be substantially completed by January 15th. However, the building permit was not even obtained by that date. After that time, Chip Martel obtainined the bldg and septic permits and installed the pilings and subfloor but he did not get approval of the Windstorm Inspection engineer. It was later learned that the subfloor didn not meet inspection requirements and the floor joists and sub floor would need to be redone.
