On Jan 25 2012 we closed on a Mortgage Loan on a Home we bought in Brownwood Texas and Affiliated Bank is the Mortgage Company that was responsible for hiring a competent Appraiser to determine fair market value of the property. The branch of this Bank that handled the loan application is located in Brownwood Tx but the branch that actually did the mortgage loan and where we sent our payments is located in Arlington Tx. To begin with the Loan Officer Pamela Svoboda that handled the loan application was very anxious to get this sale and when I expressed my concern that I did not think this property would appraise for that much assured me not to worry that she had it taken care of, that the Appraiser knew what she needed--which turned out appraising this property 65,000 over the actual value as we have now found out. The property we thought we were purchasing and that was described to us as a site built kit home on a permanent foundation has turned out to be only a 30 year old doublewide Mobile Home which the bank should never have financed, they do not finance Mobile Homes this old, no one does and Pamela Svoboda was very aware that we had no interest of buying any type of used Mobile Home. Once we realized this was only a Mobile Home I called her and told her of our discovery about this only being a Mobile Home and not the type of home we thought we bought her reply was something like" How did you find out or what makes you think so?" She then told me she would call me back and when she did she told me that the title company that was supposed to have done a title search did not do one and that her and her staff were trying to get one done. She later called me back and told me they could find out nothing that proved this was a Mobile Home, yet when we went down to the Appraisal Districts office and looked for ourselves it clearly stated MH on the papers they had on file and when we asked what that stood for we were told Mobile or Manufactured Home. I then called the Branch that financed it and explained everything and basically got told " Well the contract has already been signed and payment funded so get yourself a Lawyer" which is exactly what we did. Just a few days later Pamela Svoboda called me back up wanting to know why I did not disclose that we are making monthly payments to the iRS and that the bank was very upset about this since they were by then trying to sell the mortgage to another bank. I told her if they wanted this Mobile Home back just give us our money back and take it, we did not want a Mobile Home and that was not what we bought and it certainly did not have near the value that their Appraiser they hired came up with and that i found it very strange that all of a sudden since they were told it was only a Mobile Home they were already trying to sell this mortgage to another bank and I would tell anyone thinking of buying the mortgage that it is only a Mobile Home and that Affiliated Bank is aware of this. This has cost us much financial hardship and I have asked the bank numerous times for help since I felt like if they were not at fault in anyway that the Realtor and Appraiser also defrauded them but they have no intention of helping us claiming they have no proof that this is actually a Mobile Home even though we can prove it in many ways along with the original Mobile Home Title, the Brown County Appraisal District who actually came out here to do a new appraisal as well a another appraisal from a independent appraiser that our Attorney hired. Their total lack of interest and refusing to help us in anyway has become very suspicious making us believe that Affiliated Bank knew all along that this was only a Mobile Home but was wanting the business desperately however they could get it--including Mortgage Fraud and negligence on their part. I also filed a complaint with the Texas Real Estate Commission who did a very lengthy investigation and came back to tell us that things were very suspicious and not only do we need to be suing the Realtor but we needed to looking at including the Appraiser, the Title Company, Affiliated Bank and the previous Owner in the Lawsuit that that they have turned their findings in to their Attorney also for further investigation. So far our Attorney has chosen to include the Appraiser and the previous owner in the lawsuit while we are still looking into all this Bank has done and trying to figure out what to do about it. As of right now it looks like Affiliated Bank is going to foreclose on us and they seem very anxious to do so--once again they are refusing to help us by doing a loan modification or even putting all payments on hold till we can get done with this lawsuit, all of the money I used as working capital in order to have a income is gone, it went as payment towards the lawsuit trial which should be in early March. There are several other very important issues regarding the banks play in this, the fact that Pamela Svoboda told me that if my husbands credit did not qualify for the loan she would need me to go ahead and file my tax return for 2011 and she would need me to show my income of at least 90,000 and that I could always amend my return later. When I asked her if that wasn't fraud she told me not to worry that she did it herself in order to get her mortgage, that as long as all looks good on paper there would be no problem. Also one day before closing she called and told me she needed to set up a fake website for me to make it look like I had a legitimate business that even though she did not anticipate any problems with her bank it was better top be on the safe side in case they had some last minute issues. This I totally did not understand, I had no need for a website and I was able to prove my income but she insisted. Also we filed a report with the Texas Attorney General thinking that they handle the criminal part of all this but we just found out that they only keep reports on file so I contacted the FBI's division that handles Mortgage fraud and they have asked me to make a complete report and submit it to them. With all the parties were involved in this--Bank, Appraiser, Realtor and previous Owner this will take me some time
