Mr. Charles Bixler of T & T Home Remodeling agreed to do specified work in my condo unit at a cost of $3,020.00. I requested written documentation regarding the specifics of the work to be performed, but after 3 days I still had not received any written documentation. I provided him with $1,000 on 8/12/08 to cover cost of materials such as paint. On 8/13/08 he left a note requesting another $1,000.00 and quoted a balance due of $2,400.00. Since the numbers did not add up I called Mr. Bixler asking him if he meant the balance would be $1,400.00 after I paid in the second $1,000 dollars and he said no. I left Mr. Bixler a check on 8/14 with a detailed note to not cash the check unless he had provided a thorough written accounting of work completed and figures for work left to be done. Mr. Bixler provided no such accounting on 8/14. In fact he went and cashed the check that morning. No paint was brought in and no walls were completed. The only paperwork he left was an incomplete summary of work done; he told me he couldn't provide me with an accurate accounting because (1) his 'brief case" was stolen, and (2) his typist was out sick. I made it very clear in my note to Mr. Bixler on 8/14 that funds would be available on Friday 8/15 providing I had seen the accounting for work done. He indicated that he would personally be doing the work. I provided a house key so that he would have entry. I discovered a pair of woman's sunglasses in my master bedroom, an indication that the work was being done by someone else and that he was letting other people into the house without my approval. I noted the windows being painted were not painted completely (apron and some the upper frame was not completed). Trim work was inconsistently done. Some of the sides would be done while the others were not. Mr Bixler told me in his note on 8/13 that he was having the paint for the walls mixed and on 8/14 he would bring the paint needed to paint the walls. That never happened. Mr. Bixler could not provide an accounting of work done because he was not doing the work and had no clue as to what had been completed. He was seen out by a neighbor recruiting more business in the area. Later on 8/15, Mr. Bixler left me a voice mail indicating that he had painted the front pillars and trim....yet neglected to caulk anywhere. A neighbor of mine can vouch for the fact that Mr. Charles Bixler was not involved in painting my pillars or trim at entryway. I advised Mr. Bixler on 8/15 am that I need accounting for work we agreed on. I advised him he could leave it out front which he indicated he would do Saturday 8/16 AM. Nothing was left on Saturday. Mr. Bixler smooth talks excuses for every issue that has come up and now he's shorted me $2000.00 for unsatisfactory and incomplete work. Mr. Bixler has shown to be a man with dishonest and untrustworthy business ethics. I feel he should return the $2,000 for slovenly performed and incomplete work.
Description of Work: Documentation from Mr Bixler of work done....my response. The paperwork left itemizes several areas of discussion. There is no pricing on the paperwork you left for your eyes only . Until I see actual pricing for work done and work per our discussions, you are not allowed access to my place. Within your list of things completed and things still to do. There are several inaccurate statements in the list. Things not completed: Front door has not been touched Deck has not been touched-no cleaning or staining or whatever. Railings have not been done to satisfaction w/ pinnacles (only 12) undone as well as baseboard under them in fact they are all still dusty. Baseboard work is not complete living area where fireplace has not been done, fireplace below mantle has not been painted. Hallway upstairs and kitchen dining room area are not completed. Ceiling and drop down attic access has not been painted and nail pops have not been addressed. Side and top rails of 2nd stairway on 2nd floor as you access the stairs have not been done, nor has the side of first railing. The doors were in perfect condition and were only repainted because you indicated they needed to be resealed. The tops have never been painted. The doors to guest bedroom closet has not been cleaned or painted. The TV/ exercise room bedroom closet has not been pained. None of the windows in guest or TV/exercise room have been painted repaired or cleaned!! Main entry way, arch separating study/bathroom from front foyer is has not been painted. I indicated in note 8/14 that I needed detailed accounting of work done and work to be done to support the the quote you provided me of 4400.00 dollars and that you were to not cash my check until 8/15 providing I had pricing as we discussed in hand .neither occurred.
