We bought a one-year old house from the original homeowners in May 2016 with a one-year old pool built by Rondo Pools, LLC, Franklin, TN for the original homeowners in May 2015. The backside concrete decking was sinking and we were told by the owner of Rondo Pools, Steve Rondo, and three of his service technicians/company representatives that everything else on the pool except the backside concrete decking (which Rondo Pools said they poured on top of improperly done excavation by another subcontractor) was covered by their warranty as represented on their website. We agreed to repair the backside decking at our expense. Rondo Pools? service technicians/company representatives recommended doing the repair during the winter to avoid disrupting use of the pool during warmer times when we could swim. The owner of Pools By Rondo, Steve Rondo, had already given me a quote and we told the service technicians/company representatives several times as they came out to clean our pool each week that we would like to schedule this work to be done. No one from the company ever called us about scheduling this work. Soon after this, new cracks and sinking issues arose on the right side of the concrete decking. When Rondo Pools' service technician/representative came to inspect these new cracks, he told us the Rondo Pools? office told him as he was driving to our house that our Pentair pool pump equipment 3-year warranty was not transferrable to us from the original owners (per Pentair policy) but everything else about the pool except the backside decking (noted above) was covered by Rondo Pools' warranty. They told us they could no longer provide weekly cleaning of our pool since we were their only customer in Gallatin (about 45 minutes to an hour from their office and other customers in the Franklin, TN and Brentwood, TN areas). After the Rondo Pools' service technician/representative returned to Rondo Pools' office, we followed up with a phone call. We were told for the first time by Rondo Pools' office assistant that the warranty on the entire pool and concrete decking was not transferrable to us from the original owners. When I asked to see what was agreed upon in writing with the original owners in the original contract, they told me they could not share this information with me. All of this contradicted what we had been told by three of Rondo Pools' service technicians/company representatives on several occasions over the past year. I called Steve Rondo, the owner, to discuss this. He called back and left a brief phone message. I have tried contacting him numerous times since then, leaving phone messages and sending email. I have not heard back after several months. I even asked his brother, the owner of Rondo Pools in Arizona, to have Steve call me, but no response. Rondo Pools? website touts their warranty as one of the best in the business: "Rondo Pools offers the longest and most comprehensive warranty in the pool industry. Lifetime structural warranty, 20 year finish warranty and a 3 year bumper to bumper equipment warranty.? Unfortunately, we have found their verbal assurances, promises and guarantees, as well as their published warranty, to be worthless in our situation. I would like for Rondo Pools to keep their promises made to us about their warranty by their service technicians/company representatives on multiple occasions by repairing the concrete decking they poured, whether on improperly excavated/prepared ground by another subcontractor (which they should have verified was done properly when first constructing the pool) or on ground prepared by them. I would also like for our pool lights to be repaired. We have 3 LED pool lights and only one is barely working now.
Description of Work: A 30,000 gallon rectangular pool, approximately 15 feet X 30 feet, was built/installed with 3 programmable LED light sets, concrete decking around pool, Pentair pool pump/filter system with mineral cartridge, chlorine dispenser and ozonator for the original homeowners in May 2015 from whom we bought their home with pool in May 2016.
