Description of Work: My wife and I worked with Benchmark Realty & Mrs Lunn during a relocation from Atlanta to Nashville with a new born baby, 2 cats, 3 dogs and a job change. Mrs Lunn wanted us to sign an exclusive representation agreement and we declined upon the first meeting, stipulating, "we would not sing any exclusive contract with any agent". When we found a home to make an offer on- she sent us the buyers agreement and disclosures by email (we were in another city) for approval. The next day when she put the agreements up for electronic signing for us- she added that same 6 mo exclusive rep deal as the last 6 pages of the previously reviewed & accepted documents without notifying us. We executed the documents and had no idea until months later. When we finally purchased a home several months later with another agent- Mrs Lunn showed up a week later and demanded a commission on a sale she was not involved with, she even called the agent who represented us. We were sued in general sessions for commission and expenses, the Judge dismissed the case in 10 min. They then appealed the case to circuit court where the judge also ruled in our favor and awarded legal fees. | | |As a buyer you have many options- this should not be one of them!!! Reviews are important because they hold people accountable for the way they do business and shine the light on the process. We found a wonderful agent to work with through Zillow and were very happy with the process and the new home!
