This information is contained in a complaint filed with the Pennsylvania Attorney Generals office consumer Protection Bureau In August of 2009, we were contacted by Wayne (B****) Kapalka, owner of Pro Walls & Patio, with an offer to install decorative pavers in our driveway for a cost of $2,000. The work was to be completed in one week?s time--layers of limestone, concrete and installation of 2" stone pavers in the driveway and adjoining sidewalk (Lifetime Guarantee). Mr. Kapalka simply does not show up for work when scheduled and seldom returns phone calls. When he does, there are a myriad of excuses; usually another job that is more important, unreliable staff issues, broken down equipment, etc. (weather has only been a minor setback). We have had previous history with Mr. Kapalka, outlined later in this complaint. Our last phone calls were: October 12, 2009 where he informed us he had been sick on 3 previous workable weather days (he didn?t show up or call); and on October 14 & 15, heavy rain days, when we didn?t expect him, he called saying he would not be there. This week (10/19/09) the weather is gorgeous; I have called several times, and he again ignores our requests to keep us informed of his status. As of today, October 21, all he has done is dig up and make a mess of our driveway and sidewalk to the point that we have been cited by the city of Pittsburgh. We have not been able to use our garage since August. History: We have had both good and bad experiences with Mr. Kapalka. In the spring of 2007, he and his crew installed stone walking paths in our yard and mulched beds to our satisfaction. His company at the time was known by the name of BCM Hardscapes. In the spring of 2008, still operating as BCM Hardscapes, we had contracted with Mr. Kapalka to again mulch the beds and install decorative driveway pavers. After providing a deposit (per the contract) to buy materials and begin work, he disappeared. After numerous attempts to contact him over several months, he finally called, reneged on the contract, and returned our deposit. The current complaint began this past August 2009; he called out of the blue offering to install the decorative pavers in our driveway; now under the business name of Pro Walls & Patio. He stated that he could do the project inexpensively ($2,000) because of a supply of leftover paving stones from a previous job. We said ?no thanks? because we were very reluctant based on the last incident; he apologized and said he wanted to reestablish our trust with him. He showed us cell phone pictures of a job he just completed. He even agreed to leave his trailer on the job site as collateral for our deposit. We decided at this point to accept him at his word and give him another chance. We shook hands on it. (He has since removed his trailer.) We paid him in installments, per his signed contract; $700 to start (8/3/09); $700 midway (8/6/09) and balance of $600 when finished. (I even wrote in a stipulation ?contingent on work being completed by Friday, August 7, 2009.?) We now are out $1,400 and have a driveway we cannot use. Even if he returned all our deposits, we have to invest more money to get it back to a usable condition.
Description of Work: This man was supposed to set decorative pavers in our 250 square foot driveway. He dug up the driveway and left the site after we paid 2 thirds of the agreed to fee for the job. He did none of the work
