The job with the member was signed in July 2012 for a home her Mother had purchased in Swissvale, PA. She had looked me up after I had done work for her more than 10 years prior where she was more than happy with the results. She was now seeking me out to do this job on her Mother's house while she was living in Maryland. She changed her mind frequently, hence, there a several contracts for the work at this location/job. The job was quite large which included totally gutting out the bathroom and the kitchen, plus alot of wallboard and patchwork, electrical, plumbing, framework, new doors, etc. for all 3 floors of this home which does not include the basement. This was alot of work. At some point in October, she had given me some money, and somehow, I misplaced it. I was completely beside myself, nauseated, and afraid to tell her about it. When I did tell her, I was surprised by her response; she was not that upset and was willing to work with me provided that I pay her back. My Wife and I tried several financial institutions to obtain a loan for the money I lost, but were unable to obtain it. Still, she was willing to go forward with the work and pay for materials provided that I pay her back. Our rapport was great and I was thankful for it. At the end of November, beginning of December the relationship changed. Her attitude had begun to change, and she would call my house at bizarre times such as on Sunday mornings at 6:30am to rehash subjects about the house and then begin to cry. When I tried to talk to her, she said that she had been talking to her husband, and he said that some things weren't "right". Then, she had asked me about getting the whole interior of the house painted. That was not in the contract, as I detest painting. I suggested that she find a painter, and even said I would recommend someone for her, but she was insisting that I do it. Because I still felt guilty about losing the money, I agreed. The agreement was for the entire prep, paint, labor, and materials of three floors of the house for $2500.00. She was to wire $1,250.00 into my account, but she did not want me to wait for the money to get started on the work ~ she wanted me to get started ASAP! So, I used money from my Wife's paycheck to purchase materials to get started. Each day for 3 days, I kept asking her where the funds were, and she kept saying "they should be there today". Finally, on Friday, December 3rd, she called me and said that the funds were in my account, but that they were in a different account number because "the man at the bank said that the account number that she had did not have enough funds in it to cover the check". When I asked her if the account she put the money into had my Wife's name on it, she said Yes. Of course, I knew that what she had done was put the money into my Son's bank account, since he has the same name as I do except he is the III, and I am Junior. My Wife and I called PNC Bank, as we felt that it was a breach of my Son's privacy, and confidentiality to give her my Son's bank account numbers irregardless of whether or not OUR bank account has enough money in it to cover her check or not. They have no business fishing around in our bank accounts like that. PNC denies that any of their bank associates have done that, even though I have emails from her stating just that. Anyway, with 1,250.00 now in my Son's account, my Son is now worried that should he withdraw this money, would she be able to cancel or reverse the check. Both my Son and I go to the bank and speak with the bank managers who assure us that the check has cleared and there is no way that she can stop payment on this check. My Son then withdraws the funds and gives the money to me so I can pay the laborers since it is Friday and they want to get paid. Not even 2 hours later, my Son checks his bank account online and sees that she has stopped payment on her check. He calls the bank to see what in the world is going on. The bank now tells him that she was able to stop payment on the check because the check was filled out incorrectly; she put the monetary amount where the name should be and put the name where the monetary amount should be and therefore making the check invalid. Why the bank did not capitalize on this when cashing this is totally beyond me. But, I believe that this was done intentionally and maliciously. And, she took this money from a 22 year old boy who was using this money for his college education. Four days later, on December 7th, I receive a certified letter in the mail from her. In it is a copy of the painting contract which she has written by hand below all the stipulations of the contract that she is using her "Three Day Rite of Recision". Also included with this packet is a letter explaining why she is doing this, but it is all dated from the previous Friday...the date that she stopped payment on her check. But if you look at the "Rite of Recision" she signed it FOUR days after her signature of acceptance of the contract ~ a painting contract that I didn't even want to do in the first place but did anyway because I felt bad. And this is how I get repaid? I would love to finish this job for her if not for anyone more than for her Mother. It is a shame that what I thought was a wonderful working relationship/rapport ended up like this. I did not take advantage of anyone. Some times bad things happen to good people despite whatever safety measures you have in place. She was a Godsend and so understanding and on HER suggestion, we were to continue by her paying for materials and I was to pay her back. I have texts and emails that will back me up on this. I have texts and emails where she tells me how wonderful I am and is recommending me to some family member for a kitchen or bathroom because they were so impressed. Then, everything changed. Then, the bank fiasco. Then, this barrage of complaints to the Attorney General, BBB, Angie's List, etc. on how I call myself by so many names and so many numbers and I take advantage of the elderly and the disabled. Really???? That is so far from the truth.
