DUN-RITE ROOFING & ASPHALT

We were going to have asphalt put down in our driveway. We had a few estimates on August 9th but we picked someone who would be able to get the job done within the next month. In our contract it stated that the project would be completed by September 10th. We gave him a deposit of $700. He then called giving us excuses for not coming and doing the job. Finally, I called him October 21th letting him know that I simply wanted my money back. He told me he had already given the money to the asphalt company and so they would need to write me a check. Then for a couple of weeks he would call saying "I can't believe they haven't paid you back yet, etc etc" Then on November 4th he said he would personally give me my money back, which he didn't. Since then, I've done everything to be flexible. I ended up letting him know that he could pay me $50 a week, which he did for a couple of weeks. He has paid me $200 in total but I am still waiting on the remaining amount. He was supposed to give me $300 before Christmas but of course he never showed up. He continued to give excuses and his sister even called me trying to ask for more time for her brother. After not hearing from him for a couple of weeks he sent me a text a few days before New Years saying that he would be back in two days and get in touch with me then. Of course I have not heard back from him since and would just really like all of my money back.
