Approximately a couple of months after the installation of the hardwood floors in the family room, kitchen, and foyer the wood started to warp and cup. The family room in particular experienced severe cupping and part of the wood buckled and tented. The cupping, buckling and tenting became so bad, that the floor became a safety hazard and needed to be replaced. We contacted the contractor and Pat McGinty to fix the problem. Pat McGinty came back to our house to remove a piece of the tented wood and replaced it with plywood. We hired two flooring inspectors to assess the problem and identify what the source of the problem with the floors was. The inspectors concluded that the wood was fine, but that the floor was not installed according to manufacturer guidelines. In partiuclar, there was supposed to be a vapor barrier installed over the concrete slab subflooring in the family room, but the inspectors concluded that there was not an adequate vapor barrier installed to prevent moisture from compromising the hardwood floor. We share the flooring inspector reports with the contractor and PKM Flooring, and asked the contractor and Pat McGinty to replace the damaged floors. They refused to replace the damaged hardwood floors, so we retained legal counsel to pursue action against McGinty and the contractor. Once we had evidence concluding that the installer, Pat McGinty, improperly installed the hardwood floors, we asked Pat McGinty to cancel the second hardwood installation project and return our $4,00 down payment. Pat McGinty has still not returned our $4,000 after two years of trying to get our money back for work that was not done. In working with our lawyer, both complaints against McGinty were ultimately heard by a judge in a court of law. Pat McGinty was requested to appear at the hearing with the judge, but he did not show up. The judge ruled in favor of us and against McGinty, which resulted in a judgment against McGinty for the two projects. We are now beginning the process of enforcing the judgments against PKM Flooring and Pat McGinty, and we will also file criminal charges against Pat McGinty for stealing the $4,000 down payment that was never returned to us.
Description of Work: Pat McGinty from PKM Flooring was subcontracted by our home remodeling contractor to install hardwood floors in our family room, kitchen,front foyer, stairs and upstairs hallway. We also contracted with PKM Flooring to install hardwood floors in the dining room and living room shortly after the first project was completed. PKM flooring installed the hardwood floors in the family room, kitchen, front foyer, stairs and upstairs hallway. For the living room and dining room installation, we gave PKM flooring a payment of $4,000 to purchase the wood and to initiate the installation project. PKM did not install the hardwood floors for the dining room and living room, and Pat McGinty has not returned our $4,000 down payment.
