In the Spring of 2005, my wife and I contracted Oasis Landscaping Inc. ( President: John J. Mascaro II) to construct a EP Henry Paver two-tier patio and walk way for a price of $19,525. Upon completion, Mr. Mascaro assured us if any problems should arise with the patio and walkway, he would promptly address any issues. In the Fall of 2006, settlement was evident on the elevated tier close to the sitting wall. We tried contacting Mr. Mascaro numerous times to fix the settling elevated tier pavers. It was not until I left a message telling him I was going to file a complaint with the Better Business Bureau, that he came and repaired the elevated patio. He stated we would have no further problems with the patio after these repairs were completed. In the Spring of 2010 (after the harsh winter of 2009), settlement was again evident in many locations of the patio. On the elevated tier, the paver sitting wall is separating from the upper terrace. The paver stones and bluestone cap on the sitting wall are dipping and rising in places. The step treads to the lower patio are separating and settling . The pavers on the border of the lower patio are settling. We have had three ICPI/EP Henry Certified Paver installers come out to assess the repairs needed. They all said the paver sitting wall is separating from the upper terrace due to inadequate drainage and lack of wall reinforcement. Inadequate drainage has also caused the pavers composing the steps to the lower patio to separate and settle. On the lower patio, the paver borders are settling due to inadequate base extension out from the borders. The estimates to fix these issues have been more than $12,500 as the patio needs to be deconstructed to replace the patio base materials, rebuild the upper terrace and sitting wall with proper drainage and wall reinforcement, and repair the lower patio borders. I have attempted to contact Mr. Mascaro via phone on four different occasions (5/14/2010, 5/21/2010, 5/29/2010, and 6/2/2010) in order to make an appointment for him to evaluate the problems with our patio. The first time I called (5/14/2010), he answered his phone, informed me he would need to find the original paper work and would call me over that weekend. He never called back. On the three other occasions, I left messages on his voicemail. He has not responded as of 6/18/2010. This leaves us no choice but to file this complaint.
