The project started out very well. I worked with Kelly who is a designer with the company. We were moving forward on the project despite some setbacks with having to purchase a new car and a family emergency. When I called to resume the project and finish the kitchen, I was told that Kelly would be on a medical leave for a short time and she would be returning to work. Soon after that Iearned that Kelly was left go by Horace Miller, the company owner. Despite my inquiries to Mr. Miller, he insisted that she still worked there and she would be returning very soon. In the meantime, the plans for my project are not complete and the terms of my contract have not been met. When I call to speak to Kelly to resume planning for for the project, Mr. Miller puts me in her voice mail and she does not return my calls. I believe that Mr. Miller is lying about Kelly's employment status and it is very disturbing that he would pretend that she is employed there when I know for a fact that she has been layed off. I believe that Mr. Miller is trying to defraud me and other customers so he does not have to return our down payment or complete the terms of the contract.
Description of Work: Remodel of kitchen, including design, lighting, electrical plans, site visits to home and material selection.

Encore Kitchen & Bath Distributors, Inc. is a highly respected and most reputable company engaged is the wholesale and retail sales of custom cabinetry and has been in business for 26 consecutive years in the same community. The member contacted our firm regarding the purchase of kitchen cabinetry and entered into a written contract (with Encore Kitchen) clearly stating that a fee for design work was a non-refundable charge (see, signed and dated copy attached), for which she would receive a credit were she to proceed ahead with purchasing her cabinetry from Encore. Site visits were made, design work performed for several plan versions, cost estimates prepared for all plans, and all of this completed work was given to the member several months ago. These design plans still remain in her physical possession. The member was recently advised that Kelly – an Encore employee who was initially assigned to her project - has a very serious medical condition and that the owner, Horace Miller, would now personally assist the member with her plans and future order. It must be further noted that Kelly was merely an employee of Encore, and that all of these contractual undertakings were strictly between Encore Kitchen and the member, and NOT between Kelly and the member, regardless of whatever personal attachment the member may have for Kelly. The member has intentionally, and with ill-motive, misrepresented the facts and is engaging in distortion that would mislead an impartial observer into believing that there is an incomplete construction project and that this firm has acted in bad faith or has committed some sort of wrongdoing, which it has not. Hence, it is now patently clear that the member is seeking to obtain the good and valuable labor, time, and work of Encore (i.e., its design expertise and consultation services for which she contracted) at no cost or charge to her. ENCORE PROVIDED A DESIGNER WHO COORDINATED THE CHOOSING OF ALL OF THE HARDWARE NEEDED IN THE REMODELING. SHE ALSO HELPED ME DESIGN A KITCHEN BASED ON MY NEEDS AND THE DECORATING TASTES OF ME AND MY HUSBAND.
