We went and looked at the house and we really liked it. So we put in an offer on the house. (The realtor is the sister in law of the guy selling the house.) The we waited 2 weeks for a reply on the house. The owner came back and said it wasn't enough money. We moved on and looked around some and then we came back to the house and put in another offer ..$10,000 higher than the last offer. The question was asked "who has the mineral rights on this house?" and we were told that the gas company had all the rights, but no other gas wells would be put in around the property due to PA Laws. So the contract was done up and we signed it. 10 days after signing my fiance drove over the house to have some people look at it and the gas company is putting down a driveway to the gas well off of the driveway we would use to get the house we're in the middle of purchasing. There was a small dirt driveway there before but we were told it was only temporary. The driveway now had 10 triaxle loads of gravel on it...my fiance wasn't happy and decided to get the title search done right away. The lawyer we used was very helpful however the realtor never dropped off the paperwork to get the title search done but he did look into the mineral rights for us. It turns out that her brother in law (the owner of the house) has all the mineral rights on the 12 acres we're purchasing. She flat out lied to use and said she didn't know why the driveway was there. The driveway is there because he gets the royalty check once a month from the gas company. She failed to diclose he's had gas/mineral rights since 1992. When my fiance asked her about the rights on the property right after he got off the phone with the lawyer she said "He (the owner) has the rights and he isn't giving them up." She was a horrible realtor to begin with and was unreliable. I knew it was a conflict of interest when we found out it was her brother in law but dealt with her anyways thinking she had ethics & morals & it turns out she really doesn't have any. Save yourself the trouble and find a realtor that's willing to WORK FOR YOU!! I highly recomment you DON'T use Sandra Dei Cas as your real estate agent (Howard Hanna Agent) and think she's very far from a true professional.
