I entered into contract with Brandon Pearce of Pearce Custom Furniture on 7-5-2012. His handwritten contract stated: "All cabinets to be built, stained and installed. Built and installed by Brandon Pearce at Pearce Custom Furniture. All material paid out of cost of total price for cabinets. Kitchen cabinets $10,500 Vanities in Bathrooms $8,500 excludes bedroom closets total of $19,000" He requested his first draw of 1500.00 before starting the project, we obliged. He indicated verbally that the project should take around 6-8 weeks for completion and he requested draws weekly for work he claimed to be completing. By August 25, he had exhausted the $10,500 amount for the kitchen portion of the contract and had not delivered any cabinets. He continued to receive draws for the bathroom vanities portion of our contract. On October 21, he had been compensated a total of $19,378.81 and had delivered less than half of the kitchen cabinets and no bathroom vanities. The kitchen cabinets he delivered had no drawers, no shelves, and no doors. He requested at that time that I start paying him for another contract that he had written for trim work. That contract was also signed on 7-5-12 and stated; "all trim work cove, base, crown, to be installed for $6200.00 for labor. Excludes closets Includes fireplace, windowseals(sic)". We began extending draws for the trim contract based on his promises of completing the kitchen cabinets, bathroom vanities, and starting the trim. He claimed in a text sent in October that he was only a week away from finishing the kitchen cabinets. By December, no additional work had been completed on the kitchen cabinets, he had started bathroom cabinets and he had just started the trim work. He claimed again he was only a week from finishing. He continued to request and receive weekly draws even though I saw no progression on my project. Payments were made based on his representation of what was completed. I terminated the contracts December 16, after I had paid over $32,000, his failure to return to the job site, and failure to deliver any additional cabinet pieces. This behavior demonstrated that he was incapable of completing the projects. He had claimed that everything was finished and all he needed to do was one upper cabinet & finish some drawers. He never returned to complete any trim work, bathroom vanities, crown molding, window sills, or fireplace trim, nor did he start on or finish the upper cabinet and all the kitchen drawers and shelves. I picked up the remaining wood and pieces at his house and discovered that he was not truthful in the progress of the cabinets and further he had continually misrepresented the progress of his work to obtain payment for services he had not rendered. By December 19, after I had terminated his contract due to breach and non- performance, I found that he had completed only 7 usable doors for the kitchen (over 40 were required). No drawer fronts, no drawers, and still no shelves for the kitchen cabinets. The door fronts were not stained or sanded, as per contract, the kitchen cabinet boxes that he previously delivered were not installed, and several of the cabinets were not made according to the kitchen plans as per his bid and handwritten contract. It took 3 trim carpenters over two months and in excess of $10,000 to tear out, repair, replace and finish his work When I threatened legal action his response was "know(sic) your going to sue me I don't have anything to sue for some crappy tools and a truck that the motor and tranny are going out of with almost 200k miles." December 19 he texted; "I'm not asking for any money at all. I was going to do the doors and drawers for no money and pay for what I needed but I can't afford all of that". On December 22 he then texted; "let's just get this over with. I'm not going to pay for your material to finish theres no reason to...I will not install because of all the lawsuit threats" .."my uncle owns a law firm. so threats don't bother." When I went to his wood supplier to obtain receipts for the lumber Brandon had purchased on my credit card, they called him for permission to release the receipts. They informed me that they could not release receipts because he told them not to release anything to me. They released the receipts when they discovered that those purchases were charged to my credit card. The receipts showed that he had charged 154 BD Ft of White Oak to my credit card, there was no white oak used in my house. Also, I found that he had charged over 200 BdFt of maple to my card, of which only around 90BdFt was delivered or returned. Additionally, he charged planed and straight lined walnut ( a more expensive wood) to my card, and returned a few pieces of rough sawn walnut. He had charged several hundred dollars to my card for stain and lacquer and did not return any of those supplies to me. The Canadian county district attorney and Sheriff's Office advised me that I must proceed with civil action before they would proceed with criminal actions. My attorney further advised me that civil action would be "throwing good money after bad" because in Brandon's own words, "I don't have anything to sue for" He behaved dishonestly, unreliably, and grossly overstated his capabilities. He did not complete a single project that he started with these contracts, yet he was paid in full for both contracts and was paid additional funds based on his dishonest representation of his abilities and progress. I have documentation including photos, credit card receipts, material receipts, cancelled checks, contracts and all texts to and from him that I will share with any interested party
Description of Work: Provider bid-on and started a cabinet work and trim job at my house that was under construction; He bid to do all kitchen; bathroom cabinets and the trim work in the house. He wrote two contracts with his prices and obligations on the contracts.

We are very satisfied with Pearce Custom Furniture. His prices are very reasonable. He does excellent work. He's very easy to work with and agreeable to suggestions and changes and helping us with the design. He did everything he said he would do. He's followed up on a couple of little things that needed to be done afterwards. He's been great.

Brandon built some great dining room tables for friends. Found him online (best place to locate him is on his Facebook page: Pearce Custom Furniture). My wife and I met with him at his home workshop, and he was very friendly, very accommodating, very positive. Had a few delays getting started, that's my only and quot;con.and quot; Having worked for subcontractors before, I know how frustrating owner change orders can be. So, as an owner/buyer, I try to keep them to a minimum. On this job, there was one on the table and one on the armchairs that I just needed to have. Brandon went out of his way and re-did some work just to make sure it was right. When our table arrived, it was exactly what we wanted.
