REBUTTAL TO COMPANY RESPONSE: Briefly ? I have spoken to the Mulchman?s expert, Dr Susan Jones. She consulted her notes and said that Brad from the Mulchman had told her that my house was ?infested? with termites ? a total fabrication / lie. It was on that basis that she said that the termites had probably come from our property rather than the mulch. Dr Jones now says that she cannot determine the origin of the termites without coming out and inspecting the property and also how the mulch is treated prior to delivery. She retracts her conclusion as it was based on incorrect information ? grossly incorrect. I find it shameful that Mr. John Randle of the Mulch Man would go to this extreme to exonerate his mulch. Also, to accuse me of trying to ?hoodwink? him and ?use his company to pay for her preexisting pest problem? is so insulting to a customer who bought his product in good faith and then tried to find the least expensive solution to a big and very upsetting problem that did not exist before the arrival of the mulch. I am totally capable and willing to pay for my own prexisting ?problems?. I do not need to con someone else into paying. As previously stated, my HOUSE has NO termites. It was inspected a year ago and then again after this incident by 3 reputable termite companies who thought it would be prudent to put bait traps down OUTSIDE after they had observed the swarms of termites in the mulch on my driveway and also in one area next to the house where I had spread the mulchman?s mulch (the active termites were observed weeks later after the mulch was spread). I have acted in good faith throughout is very distressing situation. I ran down to Grandma?s Gardens the morning after the mulch was delivered to try to find out if it was indeed termites in the mulch (yes). I called up the Mulchman several times before Brad came out. I trusted him when he said he represented the owner, who would ?do the right thing?. I gave him a bag of the mulch with the termites for him to check with his ?expert? neighbor. I called about 8 termite pest companies and took a lot of time with them while they thoroughly inspected my house and explained my options. (No termites in the house). Furthermore, 1 year ago we had had Terminex out to do a check of our house as we were thinking of selling it. There was no evidence of termites at that time and the representative put sticks around the house and said if there were problems we didn?t know about they would show up on the sticks. One year later ? the sticks have not changed ? no termites had found them. On the more recent visit, Terminex offered us a $300 option that included treating for termites if they ever got into the house. Their interior house treatment is over $1500 and the company stressed that they would not be offering that option if they had seen ANY evidence of termites inside the house (why should they ? they are really selling an insurance policy). They DID see them in the mulch outside on the driveway. The second company to do an inspection was Extermital. He saw NO evidence of termites in the house after an extensive and lengthy inspection. He DID see a lot of very active termites in an area of Mulchman mulch that was close to the house. I had been told that the termites would probably die quickly ? but, there they were- a lot of them and very active. That is when we called up THE MULCHMAN GREENLINE PRODUCTS again and spoke to the owner, Mr Randle ? and Josh from Extermintal told him that there were termites that had to be treated. Their estimate was $750 (exterior only treatment) . Other companies I had spoken to over the phone were over $1000. It was after the termites were observed ?still active after 2 weeks ? that it was determined a more aggressive approach was called for. And then, I chose the least expensive and not the Cadillac option. I have also purchased Bayer termite bait to kill the above ground termites (and seriously reinjured myself trying to rake and put it down). Regarding other incorrect statements made by Mr Randle ? I did not tell the man who came to pick up the mulch that the termites might have come from my previous purchased bags of mulch ? rather that they might now be infested from HIS mulch. This man offered to sell me the mulch at a reduced price. I declined. There is no way that Mr. Randle could have legally picked up the paid for mulch from my property without my permission. I told them to pick it up. I gave the Mulchman the benefit of doubt, assuming that this was a freak occurrence with their mulch and tried to find an equitable solution. I did not and still do not think that I should have to bear the costs of termites arriving on my property via mulch. The Mulchman has found another solution ? after promising to take care of the problem ? his solution is to accuse the victim of trying to con him. It is rather twisted to think that this is ?taking pride in customer service?.
Description of Work: Delivered 4 yards of termite infested mulch I GOT TERMITES IN MY MULCH. On 6/08/2013 I went over to the Yankee Street Mulchman location and purchased 4 yards of dyed black mulch. It was delivered the same day. I had just had extensive professional landscaping done. I put some out that day. The next day, to my horror, I dumped a wheel barrow full of mulch on the ground next to my house and saw lots of white insects swarming around in the mulch. I ran upstairs and looked up termites and that is what the insects looked like. I called the Mulchman. It was Sunday and they were closed. Then I called Grandma's Gardens and they said that Mike would be able to tell if the insects were termites. I put some in a baggy and drove down there. He and 2 other people did confirm that they were termites. The next day I got Terminex to come out and she, too, said they were termites. I also had M4 pest control out and he took pictures of them and said they were termites (this was all in the pile that was on the driveway). Finally, Brad from the mulchman came out to check. He later said that it was quite shocking to see all those insects swarming around and he took a bag of them to be identified by his neighbor, an insect specialist. He said the that owner of the company was a good guy who would "do the right thing". Finally, maybe the next week, I talked to John Randle, the owner of the Mulchman. I asked him if the insects in the bag had been identified. I believe he said that the expert was out of town. I told him that they had been identified as termites by Mark from Grandma's Gardens, Terminex and M4 Pest control. He said "I guess you have your answer then". I had called up a lot of termite companies and most of the treatment prices were over $900. I spend many hours and days trying to figure out what was the lest expensive treatment that would be effective. At first I thought that the Terminex monitoring treatment would be okay ($300) a year. Mr. Randle said he would pay for that. Then, on 6/28 Extermital came out and he was poking around in the mulch on the ground next to my house where I had seen the termites before. Guess what - there were still tons of them there, swarming. I called the mulchman and the Exterminal man told him what he was seeing. So, now about 2'1/2 weeks after they arrived, I thought they had a good chance of tunneling down in the earth where spray would not get them. So, the next best treatment was to put only 5 live bait stations in the front of the house where they had been sighted and 8 more without real bait around the house to be monitored. M4 said they would do this for $525 plus tax and that was the least expensive solution that I could find. The others were $700-1200. I also called a termite expert, a professor at Ohio University, who recommended that I go out and buy a Bayer product, rake the mulch over a tarp and put the bait down on the tarp and the ground and all around the house. I did go buy it and tried to do it myself, but I had injured my back 10 days earlier and couldn't do it. So, I call up the mulchman and spoke to Jennifer and asked if someone might be able to come out and help me. She declined. We did not have termites before - we had terminex out a year ago to do an inspection and she put sticks in the ground and nothing has eaten them. The Extermital man did an extensive inspection of the house and found no evidence of termites. The landscape people dug and planted and pulled up grass and no termites were observed. I am very distressed and disappointed with this company. They have never said they were sorry - what I did hear was a person named George who called and asked me in a belligerent manner if I thought they had deliberately delivered mulch with termites jumping out of it? They came and picked up what was on my driveway and acted like they were doing me a big favor. They said that their contract (what contract? all I got was a credit card receipt) said that they are not responsible for insects. A day or so ago I sent them an email saying that the cost try to repair the problem that their termite infested mulch had caused was $525 plus tax and $40 for the bait I had bought. The owner, John Randle will no longer come to the phone and, apparently has withdrawn his offer to pay for the treatment. I feel like a fool for spending all those hours and days trying to find the least expensive treatment for the benefit of the mulch man. We would be safer with another, more expensive treatment that puts bait all around the house. And now he has apparently gone back on his promise to pay for the treatments. I certainly don't think that I should be responsible for the treatments.

The situation with (member’s name) is unfortunate. The reality of this is that she has a hard time accepting that her property has termites. We have consulted with several termite experts {not sales people from pest control companies} to help us be able to state the facts on this matter. One of the leading experts we consulted was Dr. Susan C. Jones, associate professor at Ohio State University which is considered the leading expert in her field with 35 years of research experience in termites in the state of Ohio. Dr. Jones assures us that the termites found in our pile of mulch at (member’s name’s) property came from (member’s name’s) property. FACTS: The reason that our mulch does not have termites or any other insects in it is because of our product compost temperatures. The temperature of our mulch on our property ranges from 120 degrees to 160 degrees. The mulch that (member’s name) purchased was from a pile of approximately 1000 yards that was all sold the same week with no other complaints of termites whatsoever. We have records on file for many years to show the composting temperatures and methods approved by the state and monitored by the Ohio EPA that we do not create an environment suitable for insects to live in. The experts tell us, not the pest control companies, that the situation with (member’s name) is more common than you would think. They tell us that after the mulch was delivered and dumped on her drive way and the mulch cooled down that the pile had good moisture content and the termites invaded it through the seam of the concrete pad it was dumped on. (Member’s name) stated when she first called that when the mulch was delivered she spread about half a yard of mulch on her flower beds and did not see any termites at all. When we went to (member’s name’s) home several days later to talk with her about this and look at the mulch we immediately saw termites in the pile of mulch. If we would have delivered mulch that was infested with termites there is NO WAY she would have missed this when she originally started spreading mulch the day it was delivered. It was after the fact that the mulch sat AND that is when she saw the termites. With the facts stated above the conclusion is that the termites invaded the pile of mulch from (member’s name’s) property and we did not deliver them in our mulch. (Member’s name) called us multiple times demanding that we do something about this problem. Even though we knew this problem she was having was in no way our fault The Mulchman went above and beyond to try to make (member’s name) happy. (Member’s name) first asked to have the price of her mulch reimbursed and for approximately $300 to pay for one of the pest control services that she said she would be happy with. The Mulchman agreed to this to try to appease her, but (member’s name) was calling almost daily changing her mind with what she wanted and demanding more and more. We also told her that we would remove the mulch from her property and she asked why we would want to do that? We informed her that if we were accusing someone of sending termite infested mulch we would surely want it removed from our property and she was not concerned with having the mulch removed from her property, We informed her we would be removing it. We sent someone to remove the mulch from her property and she asked if he would also take away some bags of mulch that she purchased from an unknown source and state who knows, maybe the termites came from this bagged mulch. (Member’s name) also wanted us to deliver her more mulch at no charge to her. We found this very very strange that (member’s name) would even consider wanting more mulch from a company that she was accusing of having a termite infested product… We refunded the price of the mulch to (member’s name) and decided after many many conversations with her that it was best not to move forward with anymore dealings with her because she did not strike is as ever being satisfied AND this was not a problem that we created. After discussing this at length we felt like we were being hoodwinked into paying for a problem we did not create. The Mulchman is an outstanding company that takes pride in his products and his customer service. We have sold over a million yards of mulch in the greater Dayton area in the 32 years that we have been in business. In all of our years of business we have never ever had a situation such as this. It is unfortunate that (member’s name) is trying use our company to pay for her preexisting pest problem. Dr. Susan C.
