I WOULD NOT RECOMMEND THEM BASED ON THEIR LACK OF INTEGRITY AND HONESTY IN WORKING WITH THE CUSTOMER. FAILING TO KEEP THE SOD WATERED UNTIL THE HOMEOWNER TAKES POSSESSION IS JUST ONE EXAMPLE OF FAILING TO MEET THOSE EXPECTATIONS. ACCORDING TO BOTH THE MORTGAGE BROKER AND TITLE AGENCY REPRESENTATIVE, NEITHER HAD SEEN A NEW PURCHASE CONTRACT CHANGED AT CLOSING TIME, AND THE SELLER REFUSING TO ACCEPT THE ORIGINAL TERMS. ON TOP OF THAT, EVEN THOUGH THEY REFUSED TO CLOSE USING THE CONTRACT SUBMITTED TO THE LENDER, THEY ARE UNWILLING TO REFUND THE DEPOSIT.
Description of Work: WE DID NOT CLOSE ON HOME. THE CONTRACT WAS CHANGED AT CLOSING; WHILE WORK WAS BEING PERFORMED WHEN FINAL WALK THROUGH WAS SCHEDULED. THE NEW SOD WAS DEAD. INFORMATION WAS MISREPRESENTED TO THE TITLE AGENCY. THEY ARE REFUSING TO REFUND DEPOSIT OF $500 EVEN THOUGH THEY CHANGED THE CONTRACT AT CLOSING AND WOULD NOT AGREE TO SAME TERMS.

Response from LIFESTYLE COMMUNITIES
After rescheduling twice, the member was scheduled to close on June 28th. Prior to closing, the member insisted the homeowner's association to provide him a document. The member attended the final walkthrough with a quality assurance representative, and signed off. At closing, the member remarked he would not be closing until he had received the document he requested from the association. The member demanded we move the closing for the third time. We refused to move the closing again and reminded the member that we had fulfilled our obligations in the contract. They were in breach of contract since the documentation the member requested was not made part of the contract. In accordance to the contract, Lifestyle Communities has the right to seek specific recovery of the entire balance of the purchase price. We retained the deposit, which was made as damages and released them from any further obligation. We will not be refunding the deposit since the member did not close on the home.
