Phil As you can see from the email correspondence above, this customer requested that we do this job for a flat fee of $4500 to install countertops in her kitchen. That is what we did. We held up our end of this contract. The customer then decided to change what she wanted. She decided to not install the back splash. We did what she wanted. Now she wants us to lower the price of the contract after the job was finished. In good faith, we offered a fair refund of $250.00. Now this is not good enough for her either. The balance that is due is in line, even if we would have sold this job by the square foot. With or without the splash, The balance is still $ 2000.00 for the flat fee contract. I have tried to talk with her and her husband. They have not answered my phone calls, returned my messages nor any email correspondence. Therefore, I turned it over to my lawyer. Countertop Sales & Service LLC Is in the business of selling and installing countertops, not here to argue with customers. This countertop was installed and the job turned out beautifully. The customer has gone out of her way to make this as hard as possible. We signed a contract at the amount of money she wanted spend. We met the time frame for when she wanted the countertop installed. She asked us to not install the back splash, and we did not install the back splash. She asked us to reduce the price a 2nd time after the contract was agreed upon and signed, and we did. How much more should we have to endure? She would not let them in. She wanted to know how much she owed. She looked the discount over then let my men in to install the countertops. The contract states that the balance is due the date of the installation. When the install was done, she would not pay. See above phone conversation On the balance owed: The original order was for 64 sq ft of Ice White (including back splash) for $4500. Breaks down to $70.31 per sq. ft. Measurement included 8-9 sq. ft. for back splash which would equal $632.79 +/- How is did you come up with a deduction of $250.00? . My calculation: $2,250 - 632.79 = $1,618.00 Where is she getting $70.31 per square foot?? IF the contract had been written on square footage instead of a flat fee contract, the price per square foot is still $58.88. She can't include the price of the sink and plumbing in her square foot formula to try and increase her supposed “discount” for back splash. IF she were to do her calculations correctly, she would have to start out at the original square footage formula of $4871.88. Ice White Quartz 64.50238 Sq ft @ 58.88 = $3797.88

Therefore, based upon the fact that it appears your present intention is to have the basksplash installed, my client stands ready, willing and able to do so. Please provide four different dates during the week of four hours each, within the next two weeks, when my client can arrive, finish the backsplash on your project and depart.
