Our property was in contract approximately 4 months due to the buyer recently getting out of the service and his lender at that time (Huntington Bank) pre-qualifying him while on active duty when they should have known or has reason to believe he was getting out and his income would change. The buyers agent was another agent at Remax Jared Barr who could not even write the intial contract correctly and who also holds some responsibility each time the contract expired without a previously executed extension in written form. As a word to all prospective sellers, Always make sure your agent explains the agency relationship if the buyers agent is working out of the same office as your (sellers) agent. When this occurs and once you sign the agency disclosure whether you understand it or not you have lost your representative in the transaction and at this point the two real estate agents can do pretty much what they want to close the deal. I have all the emails from this transaction to back up everything I have documented here.
Description of Work: We listed our house in Reynoldsburg with Remax Metro Plus during May 2011. We had known Brandon Prewitt and my wife had worked there as a receptionist for both Brandon and his mother when she had the brokerage. Brandon had agreed to cut us a break on the commission which he did. We also emphasized during the initial meeting that we had selected him to protect our interests in the transaction. With the purchase contract he emailed us, there was a form called "Agency Disclosure Statement" which we did not fully understand but signed and returned. We found out later that under Ohio Real Estate Law, the agent is supposed to provide a document called "Consumer Guide to Agency Relationships" which we were not given and which Mr. Prewitt attempted to have the title agent give us to sign at the closing 4 months later. The Agency Disclosure we later found basically changed Mr. Prewitts' relationship as our agent to a neutral party simply trying to make the deal. During the course of this transaction on no less than two occasions Mr. Prewitt allowed the written contract to expire without a written extension signed beforehand. When the transaction was initially set to close in August, I found it had been postponed when I happened to call the title company to check on everything. I should have heard this from Mr. Prewitt who apparently had some idea the deal was not going to close about a week before but never saw fit to tell us. Later in August Mr Prewitt advised me he thought the buyer should put an additional $2,000.00 deposit down in addition to what was already on file. Mr. Prewitt then agreed to accept $500.00 without contacting us first as the extension was contingent on $2,000.00 being deposited. When I confronted Mr. Prewitt, he simply told me it sounded as though we were not happy (duh) and he forwarded a contract termination form. By this time the property had been in contract approximately 3 months and off the market. We then asked repeatedly to meet in person with Mr. Prewitt around our schedule since my wife worked evenings and weekends. He repeatedly refused, coming up with excuses such as he was unavailable, he did not feel it was appropriate to come to our house late, etc. and then threw in our face the agency disclosure and said that he was simply a neutral party. Later, when the transaction finally closed in late September, Mr, Prewitt failed to even show up at the closing and left the previously mentioned "Consumer Guide to Agency Relationships" with the title agent attempting to cover his butt by having us sign that we had received it. We did not sign at this point and proceeded with the closing. Mr Prewitt repeatedly displayed laziness and overall unprofessional conduct during this transaction. The fact that we knew him personally made the situation all the more distasteful.
