Mustang Buildings Corp

We signed a contract with Mustang Buildings on March 3rd, 2011 to build a 42x48x13 pole barn. The estimated completion date in the contract was May 30, 2010. As of today December 16th, 2011 we have given Mark Reese and Mustang Buildings over $27,000 and we only have a wood frame and a concrete floor. The final draw in the amount of $6,827.20 is due "upon day of building completion segment & walk-through". Mr. Reese finally returned our phone calls last week and informed us that due to his finanical issues he needs us to pay the metal company directly (which is approx. $6,000) and he also wants us to pay for the remaining materials, including almost $4,000 for overhead garage doors. We have paid him everything but the remaining draw which as stated is not due until the structure is complete. This business man and owner has lied to us about when supplies have been ordered and when crews were to show up at our site for over 4 months. He blames his delays on the weather, which is only partly to blame. Even with rainfall, he has had over 9 months to complete this pole barn and his new reason for delay is financial burdens with his company. We are now consulting with an attorney to attempt and recover some of the overpayment we have made to Mark Reese.
