We signed a provisional contract on the building of a new home and submitted a $500.00 deposit. During the entire time of the process we were advised that our deposit was refundable until the time of our construction meeting and/or the closing of our loan. Not only were we advised of this during verbal conversations but e-mail correspondence as well. We had extenuating circumstances with our land, such in fact that the land developer refunded our "non-refundable" deposit of $1000.00. During the entire process we kept KHOV informed of our circumstances. As indicated in the attached e-mails, during our correspondence we were always advised that our deposit could be returned. When we decided to end the construction process due to frustrations with finding land we notified our sales rep. (on 2/12/07) and she again advised us that we would receive our deposit "no problem." I attempted to resolve the problem with her supervisor, Ms. Bennett, with no success and then with corporate.
Description of Work: We did not have work performed. We entered a contract and submitted a $500.00 deposit with a home builder. Due to uncontrollable circumstances with our land developer we could not continue with the construction process. One reason was due to some of the deed restrictions put in place by other developers and the increased costs it would have upon hour new home. I have attached some of the email correspondence, which supports the numerous times we were advised orally that we could receive our deposit back until the actual construction process began. We were advised that nothing would be done on our home until after the pre-construction meeting took place. It should be noted that we did not even have a pre-stake meeting or meet with our sales rep. to select the designs for our home.
