Mullins Construction Thomas & Christina Fronza 2423 Horseshoe Road ? Delaware Ohio 43015 Garage Project ? As Documented by Thomas Fronza We were seeking to have an additional one car garage added to our property we sought about 5-10 contractors to do the job, only about 4 actually came out to the house and actually quoted the job out. We choose Mullins Construction Services, LLC. Jeff Marth (Sales Manager at Mullins Construction) came onsite and quoted the same day he came out. A quote for $12,500.00 with ½ due as down payment ($6250.00) and ½ ($6250.00) due on completion. I asked if I would need to go get permits they were a little unclear about working in Delaware County but I did it anyway. I got a permit from Troy Township from Charlie Cooprider the Troy Township Zoning Inspector at a cost of $50.00 on 6-17-2015. I also got approval from the Delaware General Health District as this new structure is close to my septic leach field on 6-8-2015. I also paid to have my propane tank moved as part of this construction, we paid $211.46 on 7/15/15 to Schilling Propane to have the propane tank moved in preparation for this construction to begin. We talked with Mr. Marth over the phone in early June and agreed to begin construction he ran down and we cut him and check for the first half of the total payment as the down payment on 6/27/2015 with check number 4916 for a total of $6250.00. Marth agreed to get us on the construction schedule with no real time frame given. The check was cashed by Mullins Construction on 7/2/2015. Actual construction began on 9/21/2015 when Dylan Mullins arrived at my property in the afternoon to dig the trench, he dug will into the evening. See attached photos. He actually did SUBSTANTIAL damage to my blacktop driveway while digging the trench. Delivery of Stone arrived on 10/2/2015 as I actually have the receipt from The National Lime & Stone Company where Dylan and Mullins owes them $242.48. So between 9/21/2015 and 10/2/2015 I basically have a hole in the ground, no safety barriers just a giant hole in the ground. Dylan Mullins workers arrived in 10/4/2015 to actually put the stone in the hole, which was accomplished, see attached photos. And an inspection was scheduled with Delaware County, the inspector came out and he failed them almost immediately, since in Delaware County they want to see the trench before they put in the stone and Dylan Mullins was unaware of this fact. I should have stopped this project at this point. They had to recalculate their pans it as Dylan put it, ?That pushed all our subcontractors back?. As far as I can tell Dylan went round and round with the Delaware County inspector several times, thus far slowing down progress. They actually had to come back and dig the stone out and get it properly inspected by Delaware County, where the inspector told them they had to do a ?Step-Down footer?. And due to timing of Dylan?s work crews and the arrival of the inspector that actually failed several other inspections with Delaware County (at $75.00 each). So from 10/2 to 10/16 I had a hole basically. Then on 10/16/2015 they actually we able to put in the real concrete footer see attached pictures. To see the ?Step-Down Footer? they had to put in. Also note my drive way has begun deteriorating and falling into the hole as nothing as supporting it anymore. On 10/28/2015 I was done, I messaged Dylan Mullins the pictures below, where I now had not a hole but a MOAT. My text message prompted a phone call from Dylan while I was on my drive home on 10/28/2015, and he apologized over and over to my wife I had him on speakerphone in my car, I decided to speak up and said ?Stop, if apologies were nails I would have a garage built by now, So please no more apologizing, I want an plan before the end of the day or I?m done, and don?t step one more foot on my property.? I received the attached text at 10:06 PM that night Text was as follows: On October 29th we did receive block, See attached pictures. I also have the receipt for this from Mansfield Brick & Supply in Marion Ohio where Mullins Construction owes 216.23. On Saturday 10/31/2015 the mason actually arrived, a nice group of guys I would hire in a minute, they were from McClain Masonry. They did an excellent job, please note they do not work for Mullins Construction they are a subcontractor. They also had nothing really nice to say about Dylan Mullins and Mullins Construction, other than ?Yeah their checks clear, so we continue to work for them.? And he said ?I would have them do work at my house?. This gave me a rather unsettled feeling at this point. Once the Mason was done you can see from the previous text messages that yes Mullins did not order enough block or mortar so the mason was unable to actually finish the job. They came back to finish the block on 10/3/2015 once Dylan had more block and mortar delivered (The mason actually had more delivered also because he was afraid Dylan would not get it ordered in time) Note the block shortage in the front of the second picture. On 11/5/2015 I began asking about status we had an abnormally warm October/November so far and I wanted to know where we were status-wise. I had a family emergency and I had to go out of town at this point I handed over Mullins-Handling to my wife Christina Fronza at this point. My mother-in-law watches my children at my house and she kept me in the loop via pictures and text messages. See attached photos. 10/10/2015 I got this picture as an update I got a few text messages from Dylan while I was at home in Pennsylvania, see below: 10/18/2015 here was the update: 11/25/2015 here was some progress but only siding at this point. See below pictures, note the lack of siding on the back half of the garage, but the font is done. 12/22/2015 the siding on the back was finished by who I believe to be Dylan?s brothers who actually had to go buy more siding to finish the job. Note the pictures of the rear of the garage. Please take note no paint due to the temperature and no gutters or downspouts have been installed so my dirt is slowly washing away in the back and in the front my drive way is slowly washing away too. As my downspouts are sitting on the ground in this picture. 1/5/2016 So this is where we sit I have no completed garage the downspouts are not up nor are the gutters my garage doors are not installed. No further progress has been completed at this point. 1/8/2016 I paid the Delaware County Building Inspector to come out and tell me all the issues with the garage, unbeknownst to Mullins Construction (at a cost of $75.75). The problems were many. This is the list that was sent to Cody Mullins on Friday after the inspection. I also paid to get a copy of all papers on file with Delaware County including inspection documents (.30 cents). For a total of $76.05 check number 4987 paid to Delaware County Code Compliance. And Chris Stanich come to my property and gave all these recommendations. What follows is the list sent to Cody Mullins. Ridge vent not installed. (806.1) (pulled from Conditional Plan Approval) Soffit vents front and back not installed. (806.1) (pulled from Conditional Plan Approval) Mending plates or replace the double plate above garage doors and jacks are not load bearing should be sitting on plate and are not Delaware county rule of thumb is 6 ft. or greater needs 2 jack studs table 502.5(1) Ohio building code. Gable truss studded a minimum of 24 on center flat or turned on side nailed from the outside (602.3.2) siding must come off to do this properly. Where meets house need to be strapped to the house both front and back. Cross braces need attached to the house and blocked - truss bracing. Need engineered truss drawing and sealed for inspection from where trusses were built (802.10.1) (pulled from Conditional Plan Approval). Need foundation bolt 12" from the joint in the middle of the garage (R403.1.5) (pulled from Conditional Plan Approval). Need foundation bolts in front corner (R403.1.5) (pulled from Conditional Plan Approval). 1/8/2016 Per Cody Mullins, Mullins was scheduled to come and pour concrete, on 1/9/2016 but they cancelled as they were concerned about this list there were given, and we have been told they will be here to connect their issues on Monday 1/11/2015. No other assurances have been given at this point. I believe this early inspection (Delaware County Consultation ? Chris Stanich) scared them a bit. 1/13/2016 No construction happened on 1/11/2016 ? No contact to myself or my wife, or further progress. 1/17/2015 No Construction has occurred and no contact from Mullins Construction about further building of the garage.
Description of Work: We requested to have a one car garage attached to the side or our already exiting garage. They built a wooden structure that is not up to Delaware County Building code.
