Three days before the sale we noticed no one had been at the house and prices we found on items were marked like a "flea market" was taking place in our home. I called the owner Nancy Toomer and told her that we had a problem with many items. At this point she became agitated and told me that all the pricing is left to her, that I don't understand. Knowing what some of the Antiques were I questioned again and told her I was raising prices myself and expected her to acknowledge that. I had to remind her that I HIRED HER and that she worked for me. Perhaps where there is an Estate that there is no family etc... she can get away with giving items away, I don't know, but we weren't going to have that. She also told me that if folks want to barter, that she did that on the spot! I exclaimed, why, it's a two day sale and the pricing is such that it should go. If items don't go, people who left bids should be called at that point. Her explanation was "that's too much work, you think I am going to come back here for people to pick up items?" I said yes! As it was two of the beds that sold (beneath the prices marked) I made arrangements for the people to pick up. I had told Nancy earlier that I would accommodate anyone who could not take the items on the day they were sold. House of Rose Antiques did NOT prepare per their agreement. We expected to review the bids after the sale completed, thus allowing for full price payments on as much as possible. We told the Nancy that we would meet them half way and that they could accept bids on the second day, but, the first day was a fiasco. We ad friends who attended the Sale and they said people were bartering left and right. Nancy called me on a couple larger items to see if I wanted to accept the bid and to see if folks could make arrangements to pick up. It was simply a nightmare and still is.I found out that she was working on another sale for the following week. Of course she could not give our sale what it needed because she had split my two weeks with another. Just terrible. I had to request the paperwork over and over again. She did not want to release it until the people came to pick up the beds. Perplexed I asked why, they were paid for and she wasn't going back to assist, why would you hold up payment? After many calls and emails I received paperwork from the Estate Sale. Well, was I surprised. The categorized sheet was all HAND WRITTEN - Confusing at best but so unprofessional! Nancy kept telling me she has been doing this for over 18 years and I shouldn't question her. I simply cannot believe in the 21st Century any business person would hand over a Hand Written account of sales. Mind you, we expected to clear $10,000.00 - Her TOTAL SALES showed $8929.25 AND her commission with expenses that she told us she would absorb (classifie
Description of Work: House of Rose Antiques was to perform a whole house liquidation sale (Estate Sale) at our residence. Our contract stated that there would be 2 weeks of preparation. A full two weeks of preparation, everything priced, and displayed in a saleable manner. The sale was conducted on time 08/20-21/2010. The Dealer would tend to advertising the sale.Unfortunately, it did not go well. We noticed that there really was not a lot of activity at the house. We were told not to worry and she exclaimed "just let me do my job". As the time grew closer we would check to see just what was and wasn't done. We were astonished to find bags, and bags, and bags of our items in the back of the house. She claimed this was "unsaleable goods" Upon looking into the bags we found our NEW Espresso Machine, many mugs, cups, kitchen items. We have yet to finish going through the "unsaleable goods" bags as there are 10 to 12 of them.

I have conducted estate sales for over 18 years and my reputation is the backbone of my business. Member, G. Hunter Interiors hired me to conduct his sale at, not his residence, but a dilapidated house in Ft. Plain, NY that was not lived in. He hired me because he knew I could draw people to the sale and succeed in bringing in the high dollar amount. The member did not do any of the things he agreed to do prior to my starting the job, such as garbage removal and unpacking boxes. There was construction materials and debris piled in rooms, along with boxes of broken kitchen items dirty with mouse droppings. The house was in total disrepair due to broken water pipes and badly damaged ceilings & walls from overall neglect. To my dismay, there was no running water and I was without a flushing toilet for the duration of the job. I insisted on jugs of water to be brought in so I could manage. Most items were broken or damaged and were priced accordingly after careful examination. To make conditions worse, I suffered disrespect, verbal abuse and threats from the member. No one would have had the perseverance or patience to complete the job as successfully as I managed to do. My diligence to complete the job in a professional manner displays my competence amidst the challenging and unfavorable conditions when most would have walked away. The member voided my contract by changing my prices and refusing to allow me to do my job with his overbearing outbursts. Payment was sent within one week of the sale along with hand written copies of sales receipts showing items sold and my worksheet. Money for the beds was withheld until confirmation of customer pick-up-I had to call customer to confirm before sending the final payment of $775. as the member never informed me. Lastly the contract signed by the member clearly states that the homeowner is responsible to pay for all advertising. I am relieved to report that this dispute was settled, and God willing, I hope to never have to experience a job like this one again.
