Nicholas Herron, d/b/a Hitchcock and Company, is an electrical contractor in Dutchess County, New York (Rhinebeck and Red Hook). On a service call to my home to check out a partially working whole-house generator, advised the owner that the reason that the machine was not fully functional was because the controller board was and quot;fried.and quot; He sold me, what was supposed to be the latest model Generac but never delivered it. He claimed Generac sent him and quot;defectiveand quot; units and/or incomplete parts. After waiting 3 months, I opened the machine outside and found that the wire/cable that was to be attached to the control box, were left unconnected. When I reconnected the wires, the machine worked perfectly, and the wires obviously only needed to be reseated. I did not need a new machine. I called and emailed requesting refund of $3349 which had been paid in early March. Mr. Herron then, by email, advised that he would not refund because the purchase was and quot;non-cancellable.and quot; However, no purchase order was ever signed, no invoice generated and there was no compliance with New York State Home Improvement laws. It also turned out that the generator that Mr. Herron was to install would not have been the most recent model, as the model that he sold was no longer in production. The new model had more output and a 5 year, instead of 3 year warranty. Mr. Herron did not tell me this and it was only through investigation on the Generac website that this fact was revealed. The conduct of this Company and its principal, Mr. Herron, is in my view such that no consumer or business should utilize the services of this company for any electrical work or project.
