My agent (buyer's side) did not disclose that he was married to seller's agent. I was aware that the representation was considered and quot;dual agencyand quot; since they were both from CB, but still believed I would have had better leverage during negotiations had the two agents actually been conducting business at arm's length. I only discovered their relationship after closing, at which time I contacted the agents to express my concerns. Instead of responding directly to me, they brought the matter to their VP, who advised me that they had done nothing wrong. As an attorney, I know that fiduciary agents have a duty to disclose certain potential conflicts of interest. I do believe a marital relationship between two agents in an arm's length transaction is such a conflict.
