Description of Work: 1. B. Reitman Blacktop, Inc. was engaged on July 10, 2006 to perform excavation and repaving of the driveway; 2. Excavation has been insufficient to provide for proper base installation and grading away from structures; 3. Thickness of base installation has been non-uniform and less than the contractual four inches in more than half of the area to be treated; 4. Proposal/contract is deficient in not giving a completion date; 5. During the subsequent three months all efforts to compel B. Reitman to commit to perform according to agreements and proposal/contract have met with non-responsive replies or neglect; 6. Driveway has been left with grading that would cause garage to flood, unpaved and not practicable for more than three months. 7. B. Reitman has been paid $2,800 and is suing customer for additional $2,800.
