He put a strip of new sheetrock to replace prior damaged piece - painted and it looked good (that's the operative word LOOKED). We start to see what appears to water spots, so now he is going to fix the part that should have been done first -- cements a (I don't even know what to call it) a "border" where he thinks the leak is originating and proceed to put down ceramic tiles, mind you no spacers, no grout and no tile cutter and leaves - after my sister paid him (I was not at home) - needless to say, the first big rain and now it's RAINING INTO THE BEDROOM - COMING THROUGH THE ELECTRIC FAN - THE ROOM CANNOT BE USED AT THIS POINT HAD TO SHUT DOWN THE ELECTRICITY, INTERNET, ETC. IN THAT ROOM AND MY CALLS TO HIM HAVE NOT BEEN ANSWERED -- ALSO CAME TO THE JOB WITHOUT A LADDER!!! He is a friend of a co-worker of my nephew''s- I took it on her word - should have checked him out first. PLEASE DO NOT LET ANY ONE ELSE GET DUPED BY THIS CON ARTIST! I am planning on submitting a claim to small claims court.
Description of Work: Was supposed to have repaired a leak in a 2nd floor bedroom coming from the third floor patio -- he fixed the ceiling and it looked good just wasn't really fixed - he never found out exactly where the leak was coming from and even at that point repaired the ceiling before dealing with the oriiginal problem

I am writing in response to the customer complaint of [Member name removed]. I have attached copies of all contracts that I have with her including receipts and a voicemail message that she had left on July 9th, 2013. I met with [Member name removed] as a favor to my fiancé, Lisa Sperling & her co-worker [Member's nephew name removed]. I met with [Member name removed], [Member's nephew name removed], and her sister to discuss the repair of the bedroom ceiling on her second floor (see attached Contract # AL2530 & picture of damage). I provided an estimate to repair the ceiling. On April 30th, I purchased the materials to make the necessary repairs (see attached receipts). I explained to her nephew, [Member's nephew name removed] that I insulated the inside ceiling with foam in hopes that this would resolve the problem. I also told him that if there is a problem after, to please call me. [Member name removed] also asked that I provide a contract to tile her patio which she stated that’s where the leak was coming from because of the pitch of the top left hand area under the window of the ceiling that was repaired. This patio is located on the 3rd floor of the home and is a new extension that they had built a few years ago by another contractor. Because of the rainy weather in New York during the months of May & June, I wasn’t able to start the work until June 28th. As you can see in Contract # AL2533, it clearly states that customer was to supply materials. When I was there to do the tile installation with my coworker, they did not purchase all the required materials. I had to purchase the concrete, tile adhesive, and mortar tub (see attached receipts). We installed the tiles and told [Member's sister name removed] ([Member name removed]’s sister) that if it rained, they needed to cover the tile area with a tarp which I provided to them to prevent the tiles from coming up. I also told her that they could not walk on the tiles since the grout was never purchased. My fiancé spoke with [Member's nephew name removed] and told him that they needed to purchase the grout and pick the color they prefer for the work to be completed. [Member's nephew name removed]’s response was for me to purchase the grout which I did out of my pocket on June 30. As you can see, [Member name removed] has not paid for any materials or labor for this contract. She also asked me to pick up extra concrete to fix the slabs on the wall. Again, I purchased the concrete out of pocket and asked [Member's nephew name removed] to make sure that if it rained to put the bag inside. Unfortuately, [Member's nephew name removed] did not and I had to purchase another bag of concrete out of my pocket to replace the one he had left out in the rain. On July 2nd, [Member's nephew name removed] was screaming/upset and told my fiancé while they were at their place of business, that the whole ceiling was collapsing from the rain. Lisa immediately called me and was upset by the way he spoke to her at work and asked if I could stop by and check to see what the problem was after I was finished with the job that I was working on. [Member's nephew name removed] also called me when he went home to ask if I would stop by and check out the problem. As you can see in the picture, the ceiling did not collapse. It was the tape line (seam where the two pieces of sheetrock meet) that was damaged. Myself and [Member's nephew name removed] went outside and noticed that the gutters (located above his window on the third floor) was ½” away from the wall. Depositing the water towards the window of the room that I repaired the ceiling. I don’t have a ladder that could reach the 3 stories in height and [Member's nephew name removed] suggested that he would get the ladder from a neighbor and call me. Until this day, he has yet to contact me. Later that evening (July 2nd), I received a phone call from [Member name removed] who was screaming, yelling and verbally abusive towards me as a professional because of the leak in the ceiling. I explained to her that I spoke with her nephew and once he got the ladder, I would come and take a look. I do not have a contract with them to fix the gutters. On July 9th, (see attached email of message from [Member name removed]) she states that if I was not coming back, she wish I would have the decency to let her know and that she will take whatever legal action necessary. I have written a response to her voicemail on July 12, as speaking to her is not going to get anywhere. As of today, I have not heard from [Member name removed] or [Member's nephew name removed] until you contacted me to state that she has written a review regarding the work. The issue with the customer is that (1) she has not paid for 2 of the 3 contracts, and (2) there is a lack of communication between the Aunt, Nephew & Sister. Which leaves us in the middle of not knowing what to do or who is paying for these contracts which still is open. I feel very uncomfortable with returning to help finish the work. As you can see, all my referrals have been 5 Stars with Angie’s List & Home Advisor. I have not had any issues with any other customers with this type of treatment. As far as a refund of $800, it clearly states on Contract # AL2530 – which was signed and completed as we did a final walk thru before we have anyone sign the contracts. We only charged her $500 for materials & labor. [Member name removed] has not paid for the ceramic tile installation or the slab work. So I cannot see how she is asking for $800? I hope this clears up the issue with the review Ms. [Member name removed] has written on your site and I wish to have this removed from my ratings. If [Member name removed] wishes to pay these contracts, I will be more than happy to finish the work. If you have any questions, please do not hesitate to contact me.
