Most times when I needed to contact the company they were pleasant and helpful. Occasionally I would get someone that couldn't understand why I was concerned when I would call after the 10th day of the due date to ask if the purchaser had made the payment. Like I was bothering them. Luckily this only happened about 3 times over 5 years. When I was at the original closing at the title company I was told that all correspondence would go through Sunwest Trust. The contract indicated that the purchaser would provide evidence each year of payment of taxes and insurance. I was under the impression that the purchaser would send documentation to Sunwest Trust. If anything they did not receive this information to comply with the contract they would notify me. The first couple of years I did check on the website in regards to the taxes and the taxes had been paid. Due to few tramatic events the past few years I didn't stay on top of double checking the taxes. I never heard anything from the escrow company, so thought everything was alright. The purchaser ended up returning the property to me, due to some financial problems. I found that there was 3 years of back taxes owed. I have not idea if there was any insurance on the property since closing, plus city leans, violations, over due water bills, etc. It was pointed out to me that I would have to pay the fee for the Special Warranty Deed to return the property to me. I consulted with a probate lawyer about the contract and he told me that the escrow company had definately dropped the baIl on not verifying that the taxes were paid. I asked if he thought it would be inappropriate to ask for them to pay the fee. He said he thought that was very reasonable. So, when I was told again about the fee I asked if I could talk to the manager, Mr. Arthur Doughtery (sp?) . I told him I didn't think I should be charged for the termination fee, since I felt they had not lived up to what they were suppose to do in verifying the taxes and insurance each year. Honestly I tried being polite through all of this. Arthur stated that I was accusing them of doing something wrong and they hadn't. That I should not have gone by what the title company said, but called them to ask them about questions regarding how I would find out about taxes and insurance. If I had asked nicely and said that I was in a bad situation he may have considered removing the fee. My question was - Was I not to believe anything the title company told me then? He said I was just being (I don't remember the exact work, but the kinder word would be) silly. I was not going to get the fee removed because it would indicate they were in the wrong and they weren't. This was my first time being a seller in a real estate contract and maybe I don't know as much as I should, but I didn't need his attitude through all of this. There was over $8,000 in taxes, so in comparison the termination fee of $34 was probably just a tiny drop in the bucket. This didn't even include the filing fee; I had to go downtown to file and pay for the part, too. The overall rating is for the 5 years I dealt with the company and not just this one incident.
