April 16, 2011 I signed a contract to install a Sunroom at my home at which time I gave the company a 30 percent deposit. June 28, 2011 construction began. July 3, 2011 Jason Card the contractor on the job states due to holiday they will not be back till after the holiday. Tuesday after that holiday company is a no show. Wednesday workers show up around 11am, not explanation. Work about 4-5 hours, and this was their regular workday pattern when they did show. My families entire summer was wasted with telephone calls to this company to complete the job. We were unable to use the yard with construction debris in the yard. Toward the end of the summer my husband and I cleaned some of the debris to begin raking the leaves. Multiple calls made to find out when the job would be completed. September 26, 2011-Unscheduled, a worker from the company showed up at the door stating he was here to install stair railings. December 8 2011 Job remains incomplete To this present date they have not finished a deck 12x 20 at the ground level that was on the contract to be installed. I have a mud pit where a deck should be. I have called left messages without response since early September. Summer has come and gone and the work remains undone. Winter will be upon us and the phone calls go unanswered. In addition I was told by a licensed electrician that the wiring is not code for NY. My electric has not been connected as there is concern for the electric installation as well. This has yet to be resolved as Tristate Building Specialties/Jason Card/ Dominick do not respond to any calls or contact made to this business. A report to the Better Business Bureau of New Jersey remain unanswered. DO NOT USE THIS COMPANY OR ANY OF THEIR EMPLOYEES if you want the job completed. Pictures of the job to be posted at a later date. I have the pictures as well.

After they applied for the permit we learned the cost to obtain an additionally required DEP permit was $5K higher and took 6+ months to obtain. We learned the company had experience that additional DEP permits may be needed but they did not disclose. We could not afford the additional $5K for the permits. Due to an artfully worded contract we could not recover our 30% deposit. We took the company to arbitration but we were denied a full refund. The arbitrator wrote, there is evidence the business acted in less than a professional fashion in its dealings with the customers. Such conduct is unacceptable from any business. The business might have retained the customer as a client had it sought to rework the project to account for the increased costs and delays associated with the application to DEP. Instead the business responded with an argument and yelling over the phone. However, such unprofessional conduct does not serve to void an agreement between the business and customer.
Description of Work: Company was to provide blueprints, apply for permits, remove existing deck and install four season sunroom. Company supplied generic and incorrect blueprints, waited two months to attempt to apply for a township permit. Company did no further work.

OUR INSTALLATION TIME FRAME IS BASED ON THE CUSTOMER FURNISHING ALL NEEDED DOCUMENTS FOR US TO PROCEED WITH THE PROJECT IN A TIMELY MANNER. NOT ONLY DID THE CUSTOMER FAIL TO PROVIDE US WITH AN ACCURATE COPY OF THEIR SURVEY FOR 6 WEEKS, BUT WHEN WE DID ACTUALLY RECEIVE ONE, IT WAS DUE TO AN INTERVENTION FROM THE SURVEY COMPANY THAT WE USE. THE DID US A FAVOR IN RETURN FOR ALL THE WORK THAT WE GET THEM, AND PULLED STRINGS TO GET A COPY FROM THE ORIGINAL SURVEY COMPANY WHO HAD SINCE GONE OUT OF BUSINESS. WE WERE NOTIFIED OF THE ADDITIONAL DEP PERMIT NEEDED AFTER WE WALKED IN THE CUSTOMER'S ZONING APPLICATION. THIS EXTRA PERMIT WAS NECESSARY DUE TO THE HOMEOWNER'S PROPERTY SITTING ON ZONE B WETLANDS. THE CUSTOMER KNEW AHEAD OF TIME THAT A VARIANCE WOULD BE NEEDED, AND KNEW THAT A VARIANCE WOULD EXTEND THEIR TIMELINE FOR SIX TO NINE MONTHS. THE CUSTOMER ALSO EXPECTED FROM US TO ABSORB THE COSTS FOR THESE ADDITIONAL TOWNSHIP REQUIREMENTS. IT IS CLEARLY STATED IN THE CUSTOMER'S AGREEMENT THAT ANY VARIANCES OR OTHER TOWNSHIP REQUIREMENTS ARE NOT INCLUDED IN THE CONTRACT PRICE. WHEN THE CUSTOMER CALLED IN TO CANCEL, THEY HAD BEEN UNDER CONTRACT FOR NEARLY THREE MONTHS. WE HAD ALREADY GENERATED THE ENGINEERING DRAWINGS FOR THEIR PROJECT, AND INVESTED NUMEROUS MAN-HOURS INTO TRYING TO GET APPROVAL FROM THEIR TOWN. THEY WERE RETURNED THE DIFFERENCE BETWEEN THEIR DEPOSIT AND THE CANCELLATION PENALTIES OUTLINED CLEARLY IN THEIR AGREEMENT. THESE PENALTIES ARE TO OFFSET OUR INCURRED COSTS.

THEY WERE VERY PROFESSIONAL IN ALL PHASES OF THE JOB. WHEN EVER WE HAD A QUESTION, THEY ANSWERED IT IN A WAY THAT WE COULD UNDERSTAND. I THOUGHT THE QUALITY OF THE WORK COULD HAVE BEEN A LITTLE BETTER AND THEIR WORK WAS REALLY EXPENSIVE.
