Description of Work: Tear out & repave driveway

Description of Work: I OVER paid $800 (as a new homeowner) for a driveway. We are to receive a hot patch (approx 4ft by 3 ft) and to have the remainder of my driveway properly sealed. I outlined my areas of concern where there were significant cracks and asked if they would be filled during the sealing process. I was assured they would be. They came out the second week of October on a cloudy day with rain threatening and applied the hot patch. After that the owner of the company (Mac) left and his guys cleaned and sealed the driveway. It rained approximately 30 minutes after they left. The sealing never filled ANY cracks at all and I called immediately. It took two weeks to get him on the phone and by then he was 'done for the season'. He said he'd redo the job at no charge next year and to call in May. I called in May, and in late June Mac came out to look at the driveway again. He said they'd come in August to reseal it. Since then I have been calling on a weekly basis and every week he says 'this week'. He no longer answers my calls unless I block my number or call from an unknown phone. I stated on my last call that I just want him to complete the job I paid him (OVER paid) him for. That he knew that they had done a horrible job and I don't understand why he can't just honor his work and come and do the job right. I know I can pay someone else a few hundred to do this, but it's really the principle of it at this point. I made the mistake of giving him cash in hand (for a 'discount') and have no recourse at this point. Today he said he'd be there Thursday or Friday, but I'm not going to hold my breath. He's out of the Hopatcong area... so be warned.
