THE FEW CABINETS THAT WERE DELIVERED WERE INCOMPLETE, DEFECTIVE AND UNUSEABLE. Mr. Alston's workshop is an old unconditioned shed and our cabinets were exposed to high humidity. When they were brought into our home, they warped, cracked and knots began popping out of the wood. The cabinets were supposed to be delivered finished, however they were just bare wood, with burn marks from dull cutting tools and wood putty filling defects. He did not build the cabinets deep enough (from front to back), so we were unable to fit sinks and faucets in them, despite being provided the paper sink cut outs that sink manufacturers included with the sinks. One of the master bathroom cabinets had two drawers which you could only partially open, because the drawers collided with the tub deck surround, that he also built. The cabinets were not square and you could see this with your naked eye. Doors were hung crooked and drawers were loose on their gliders. One portion of the installed kitchen cabinets did not have a backboard, so you could see the drywall when you looked into the cabinet. One of the bathroom cabinets was damaged upon delivery and it also damaged the door jamb in our bathroom, when the cabinet was dropped and cracked. Mr. Alston denied this, although there was a witness and Mr. Alston borrowed a screw from one of the subcontractors to try fix the still visible crack. We ordered raised panel doors. To create a "raised panel effect" numerous doors and drawers had wood glued to them to create the illusion of a raised panel of wood. When Mr. Alston installed the powder room cabinet, he seated the side of the cabinet on top of the base board, so the front legs of the vanity were suspended in mid air. After Mr. Alston quit, we had two professional cabinet maker's come to our home, to see if we could fix the cabinets. They told us it would cost more to fix the cabinets, than to make new ones. They made us aware of all of the structural and cosmetic defects in our cabinets. They also told us that these cabinets were the worst that they had ever seen and this man should not be building cabinets. Mr. Alston misrepresented himself, stating to us and an independant witness that he was a master cabinet maker and actually calling himself an engineer, in addition to taking money under false pretenses.
Description of Work: James Alston presented himself to us as a master cabinetmaker and was hired to build cabinets in our new home construction. This included cabinets in a laundry room, a mudroom, a powder room, a guest bathroom, a master bathroom w/tub surround and two sides of a kitchen. Mr. Alston signed a time of essence contract stating that the cabinets would be completed, delivered and installed within a given time frame and schedule of payments. He delivered one third of the kitchen cabinets. He then took money under false pretenses, telling us that he was due another installment of payment since he was at a milestone in his contract with all of the cabinets built. He claimed he just needed to hire and pay someone to help him finish sanding and applying the finish to the cabinets before he could deliver them. In order to obtain this money, Mr. Alston signed an extension contract at our attorney's office, promising to have everything completed and delivered. We only received part of our order, which included incomplete and unuseable cabinets. We received one third of the kitchen cabinets, a powder room cabinet, guest bathroom cabinet, masterbath cabinets and a partial tub surround. We did NOT receive the laundry room cabinets, the mudroom cabinets, the rest of the tub surround and the remainder of the kitchen cabinets. Mr. Alston then admitted to us that the rest of the cabinets were not done and he was quitting. He promptly went to our attorney and also told him he was quitting. After he quit, Mr. Alston said he could fix everything if we gave him more money.
